3、4年1月1日起施行。Premier:LiQiang总理李强October16,20232023年10月16日RegulationontheCyberspaceProtectionofMinors未成年人网络保护条例ChapterIGeneralProvisions第一章总则Article1ThisRegulationisdevelopedinaccordancewiththeLawofthePeoplesRepublicofChinaontheProtectionofMinors,theCybersecurityLawofthePeople,sRepublicofChina,thePerson

4、alInformationProtectionLawofthePeoplesRepublicofChina5andotherapplicablelawstocreateanetworkenvironmentconducivetothephysicalandmentalhealthofminorsandsafeguardthelawfulrightsandinterestsofminors.第一条为了营造有利于未成年人身心健康的网络环境，保障未成年人合法权益，根据中华人民共和国未成年人保护法、中华人民共和国网络安全法、中华人民共和国个人信息保护法等法律，制定本条例。Article2Theprot

5、ectionofminorsincyberspaceshalladheretotheleadershipoftheCommunistPartyofChina,theguidanceofcoresocialistvaluesandtheprincipleofbeingmostbeneficialtotheminors,beinlinewiththephysicalandmentalhealthdevelopmentofminorsandthelawandcharacteristicsofcyberspace,andbesubjecttosocialco-governance.第二条未成年人网络保

6、护工作应当坚持中国共产党的领导，坚持以社会主义核心价值观为引领，坚持最有利于未成年人的原则，适应未成年人身心健康发展和网络空间的规律和特点，实行社会共治。Article3Thecyberspaceaffairsdepartmentofthestateshallberesponsiblefortheoverallcoordinationoftheprotectionofminorsincyberspaceandeffectivelyprotectminorsincyberspaceaccordingtoitsduties.Thepressandpublicationandfilmdepartme

7、ntsofthestateandtheeducation,telecommunications,publicsecurity,civilaffairs,cultureandtourism,health,marketregulation,radioandtelevision,andotherrelevantdepartmentsoftheStateCouncilshalleffectivelyprotectminorsincyberspaceaccordingtotheirrespectiveduties.第三条国家网信部门负责统筹协调未成年人网络保护工作，并依据职责做好未成年人网络保护工作。国

8、家新闻出版、电影部门和国务院教育、电信、公安、民政、文化和旅游、卫生健康、市场监督管理、广播电视等有关部门依据各自职责做好未成年人网络保护工作。县级以上地方人民政府及其有 关部门依据各自职责做好未成 年人网络保护工作。Localpeoplesgovernmentsatandabovethecountylevelandtheirrelevantdepartmentsshalleffectivelyprotectminorsincyberspaceaccordingtotheirrespectiveduties.第四条共产主义青年 团、妇女联合会、工会、残疾 人联合会、关心下一代工作委 员会、青年

9、联合会、学生联合 会、少年先锋队以及其他人民 团体、有关社会组织、基层群 众性自治组织，协助有关部门 做好未成年人网络保护工作， 维护未成年人合法权益。Article4Thecommunistyouthleagueorganizations,womensfederations,tradeunions,disabledpersonsfederations,workingcommitteesforthecareofthenextgeneration,youthfederations,students*federations,youngpioneers,organizations,andotherp

10、eoplesorganizations,relevantsocialorganizations,andbasicself-governingmassorganizationsshallassistrelevantauthoritiesineffectivelyprotectingminorsincyberspaceandsafeguardingtheminors*lawfulrightsandinterests.第五条学校、家庭应当 教育引导未成年人参加有益身 心健康的活动，科学、文明、 安全、合理使用网络，预防和 干预未成年人沉迷网络。Article5Schoolsandfamiliessh

11、alleducateandguideminorstoparticipateinactivitiesthatareconducivetotheirphysicalandmentalhealthandtoaccessInternetspaceinascientific,civilized,safe,andreasonablemanner,soastopreventandinterveneinminorsaddictiontotheInternet.第六条 网络产品和服务 提供者、个人信息处理者、智 能终端产品制造者和销售者应 当遵守法律、行政法规和国家 有关规定，尊重社会公德，遵 守商业道德，诚实

12、信用，履行 未成年人网络保护义务，承担 社会责任。Article6Onlineproductandserviceproviders,personalinformationprocessors,andintelligentterminalproductmanufacturersandsellersshallabidebylaws,administrativeregulations,andtherelevantprovisionsissuedbythestate,respectsocialmorality,observebusinessethics,actingoodfaith,fulfillth

13、eobligationofprotectingminorsincyberspace,andassumesocialresponsibilities.第七条 网络产品和服务 提供者、个人信息处理者、智 能终端产品制造者和销售者应 当接受政府和社会的监督，配 合有关部门依法实施涉及未成Article7Onlineproductandserviceproviders,personalinformationprocessors,andintelligentterminalproductmanufacturersandsellersshallacceptgovernmentandsocialsuperv

14、ision,cooperatewithrelevantdepartmentsincarryingoutthesupervisionandinspectioninvolvingthe年人网络保护工作的监督检 查，建立便捷、合理、有效的 投诉、举报渠道，通过显著方 式公布投诉、举报途径和方 法，及时受理并处理公众投 诉、举报。protectionofminorsincyberspaceinaccordancewiththelaw,establishconvenient,reasonable,andeffectivechannelsforfilingcomplaintsandreports,publ

15、icizethechannelsandmethodsforfilingcomplaintsandreportsinaconspicuousmanner,andpromptlyacceptandhandlethecomplaintsandreportsfiledbythepublic.第八条任何组织和个人 发现违反本条例规定的，可以 向网信、新闻出版、电影、教 育、电信、公安、民政、文化 和旅游、卫生健康、市场监督 管理、广播电视等有关部门投 诉、举报。收到投诉、举报的 部门应当及时依法作出处理； 不属于本部门职责的，应当及 时移送有权处理的部门。Article8AnyorganizationorindividualdiscoveringanyviolationofthisRegulationmayfileacomplaintorreportwiththecyberspaceaffairs,pressandpublication,film,education,telecommunications,publicsecurity,civilaffairs,cultureandtourism,health,marketregulation,radioandtelevision,ando
