保险销售行为管理办法（2023年9月20日国家金融 监督管理总局令2023年第2 号公布自2024年3月1日 起施行）第一章总则第一条为保护投保人、被保 险人、受益人的合法权益，规 范保险销售行为，统一保险销 售行为监管要求，根据中华 人民共和国保险法国务院 办公厅关于加强金融消费者权 益保护工作的指导意见等法 律、行政法规和文件，制定本保险销售行为管理办法MeasuresfortheAdministrationofInsuranceSalesActivities制定机关：国家金融监督管理总局发文字号：国家金融监督管理总局令2023年第2号公布日期：2023.09.20施行日期：2024.03.01效力位阶：部门规章法规类别：保险综合规定IssuingAuthority：NationalAdministrationOfFinancialRegulationDocumentNumber：OrderNo.22023oftheNationalAdministrationofFinancialRegulationDateIssued：09-20-2023EffectiveDate：03-01-20241.evelofAuthority：DepartmentalRulesAreaofLaw:GeneralProvisionsonInsuranceMeasuresfortheAdministrationofInsuranceSalesActivities(IssuedbyOrderNo.22023oftheNationalAdministrationofFinancialRegulationonSeptember20,2023andcomingintoforceonMarch1,2024)ChapterIGeneralProvisionsArticle1TheseMeasuresaredevelopedinaccordancewiththeInsuranceLawofthePeople'sRepublicofChina,theGuidingOpinionsoftheGeneralOfficeoftheStateCouncilonStrengtheningtheProtectionofFinancialConsumers*RightsandInterests,andotherapplicablelaws,administrativeregulations,anddocumentstoprotectthelawfulrightsandinterestsofinsuranceapplicants,theinsured,andthebeneficiaries,regulateinsurancesalesactivities,力、法。andunifyregulatoryrequirementsforinsurancesalesactivities.Article2SalesactivitiesconductedbyinsurancecompaniesforthepurposeofconcludinginsurancecontractsandsalesactivitiesconductedbyinsuranceintermediariesandinsurancesalespersonsforthepurposeofconcludinginsurancecontractsasentrustedbyorincooperationwithinsurancecompaniesshallbesubjecttotheseMeasures.ForthepurposesoftheseMeasures,“insuranceCompaniesndonotincludereinsurancecompanies.ForthepurposesoftheseMeasures,“insuranceintermediariesincludeinsuranceagenciesandinsurancebrokers.Insuranceagenciesincludespecializedinsuranceagenciesandsidelineinsuranceagencies.ForthepurposesoftheseMeasures,“insurancesalespersons"includetheemployeesofinsurancecompanieswhoengageininsurancesales,personalinsuranceagents,andpersonnelofotheremploymentformsincludedinthemanagementofsalespersons,personnelofinsuranceagencieswhoengageintheinsuranceagencybusiness,andpersonnelofinsurancebrokerswhoengageintheinsurancebrokeragebusiness.Article3Otherinstitutionsandindividualsshallnotengageininsurancesalesactivities,exceptforthefollowinginstitutionsandpersonnel:第二条保险公司为订立保险 合同所开展的销售行为，保险 中介机构、保险销售人员受保 险公司委托或者与保险公司合 作为订立保险合同所开展的销 售行为，应当遵守本办法的规 定。本办法所称保险公司不包括再 保险公司。本办法所称保险中介机构包 括：保险代理机构和保险经纪 人。保险代理机构包括专业代 理机构和兼业代理机构。本办法所称保险销售人员包 括：保险公司中从事保险销售 的员工、个人保险代理人及纳 入销售人员管理的其他用工形 式的人员，保险代理机构中从 事保险代理的人员，保险经纪 人中从事保险经纪业务的人 员。第三条除下列机构和人员 外，其他机构和个人不得从事 保险销售行为：（一）保险公司和保险中介机 构；(1) Insurancecompaniesandinsuranceintermediaries.(2) Insurancesalespersons.Aninsurancecompanyorinsuranceintermediaryshallhandlepracticingregistrationforinsurancesalespersonsaffiliatedtoit.Article4Insurancesalesactivitiesshallfollowtheprinciplesofcompliancewithlawsandregulations,equalityandvoluntariness,fairnessandappropriateness,honestyandgoodfaith,andrespectandprotectthelawfulrightsandinterestsofinsuranceapplicants,theinsured,andthebeneficiaries.Article5ForthepurposesoftheseMeasures,'Insurancesalesactivitiesincludeactivitiesbeforeinsurancesales,activitiesduringinsurancesales,andactivitiesafterinsurancesales.''Activitiesbeforeinsurancesalesnmeansthataninsurancecompanyandaninsuranceintermediaryentrustedbyorcooperatingwiththeinsurancecompanyandinsurancesalespersonscreatetheenvironmentandprepareconditionsfortheconclusionofaninsurancecontract,andsolicittheoppositepartytotheinsurancecontract."Activitiesduringinsurancesalesmeansthataninsurancecompanyandaninsuranceintermediaryentrustedbyorcooperatingwiththeinsurancecompanyandinsurancesalespersonscommunicateandnegotiatewithaspecificoppositepartyonthecontentoftheinsurancecontracttobesigned,andmakeoffersorundertakings.（二）保险销售人员。保险公司、保险中介机构应当 为其所属的保险销售人员办理 执业登记。第四条 保险销售行为应当遵 循依法合规、平等自愿、公平 适当、诚实守信等原则，尊重 和保障投保人、被保险人、受 益人的合法权益。第五条本办法所称保险销售行为包括保险销售前行为、保险销售中行为和保险销售后行 为。保险销售前行为是指保险公司 及受其委托或者与其合作的保 险中介机构、保险销售人员为 订立保险合同创造环境、准备 条件、招揽保险合同相对人的 行为。保险销售中行为是指保险公司 及受其委托或者与其合作的保 险中介机构、保险销售人员与 特定相对人为订立保险合同就 合同内容进行沟通、商谈，作 出要约或承诺的行为。保险销售后行为是指保险公司uActivitiesafterinsurancesalesmeansthataninsurancecompanyandaninsuranceintermediaryentrustedbyorcooperatingwiththeinsurancecompanyandinsurancesalespersonsfulfiltheaccompanyingobligationsarisingfromtheconclusionofaninsurancecontractsuchasdeliveringinsurancepolicies,makingreturnvisits,andprovidingnotificationsofinformationinaccordancewiththeapplicablelaws,regulations,andregulatoryrules.Article6Aninsurancecompanyorinsuranceintermediaryshallintroduceinsuranceknowledgeandgiveinsuranceconsumptionriskwarningstothepubliconaperiodicalbasisinappropriatemethodsandeasy-to-understandlanguage,andfocusonexplainingprofessionaltermsininsuranceclauses,concentratedquestions,actsthatarelikelytocausedisputes,variousrisksininsuranceconsumption,andothercontents.Article7Aninsurancecompanyorinsuranceintermediaryshallcollectandprocesst
