中华人民共和国交通运输部令（2023年第22号）快递市场管理办法已于2023年 12月8日经第28次部务会议通过， 现予公布，自2024年3月1日起施 行。部长李小鹏2023年12月17日快递市场管理办法第一章总则笫一条为了加强快递市场监 督管理，保障快递服务质量和安快递市场管理办法(2023)MeasuresfortheAdministrationoftheExpressDeliveryMarket(2023)制定机关：交通运榆部发文字号：中华人民共和国交通运榆部令2023年第22号公布日期：2023.12.17施行日期：2024.03.01效力位阶：部门规章法规类别：交通运榆综合规定IssuingAuthority：MinistryofTransportDocumentNumber：OrderNo.222023oftheMinistryOfTransportofthePeople'sRepublicofChinaDateIssued：12-17-2023EffectiveDate：03-01-20241.evelofAuthority：DepartmentalRulesAreaofLaw:GeneralProvisionsonTransportationOrderoftheMinistryofTransportofthePeople,sRepublicofChina(No.222023)TheMeasuresfortheAdministrationoftheExpressDeliveryMarket,asadoptedatthe28thexecutivemeetingoftheMinistryofTransportonDecember8,2023,areherebyissuedandshallcomeintoforceonMarch1,2024.Minister:LiXiaopengDecember17,2023MeasuresfortheAdministrationoftheExpressDeliveryMarketChapterIGeneralProvisionsArticle 1 TheseMeasuresaredevelopedinaccordancewiththePostalLawofthePeople'sRepublicofChina,theInterimRegulationonExpressDelivery,andotherapplicablelawsandadministrativeregulationsforthepurposesofstrengtheningthesupervisionandadministrationoftheexpressdeliverymarket,ensuringthequalityandsecurityofexpressdeliveryservices,protectingthelawfulrightsandinterestsofusers,expressdeliverypractitionersandenterprisesprovidingexpressdeliveryservices,andpromotingthesounddevelopmentoftheexpressdeliveryindustry.Article 2 TheseMeasuresshallapplytoexpressdeliverybusinessoperations,theuseofexpressdeliveryservices,andthesupervisionandadministrationoftheexpressdeliverymarketwithintheterritoryofthePeople'sRepublicofChina.Article 3 Enterprisesprovidingexpressdeliveryservicesshallcomplywithlawsandregulationsandpublicorderandgoodcustoms,conserveresourcesandprotecttheecologyandenvironmentinaccordancewiththelaw,andprovideuserswithrapid,accurate,safe,andconvenientexpressdeliveryservices.Article4Wheretwoormoreenterprisesprovidingexpressdeliveryservicesuseaunifiedtrademark,tradename,expresswaybills,andsupportinginformationsystem,theyshallenterintoawrittenagreementtospecifytheirrespectiverightsandobligations,observecommonserviceagreements,andconductunifiedmanagementinaspectssuchasservicequality,securityguarantee,businessprocess,ecologicalandenvironmentalprotection,andprotectingtherightsandinterestsofpractitioners.Theenterprisethatownsthetrademark,tradename,expresswaybills,andsupportinginformationsystemisreferredtoastheheadquartersexpressdeliveryenterprise.全，维护用户、快递从业人员和经 营快递业务的企业的合法权益，促 进快递业健康发展，根据中华人 民共和国邮政法快递暂行条 例等法律、行政法规，制定本办 法。第二条在中华人民共和国境 内从事快递业务经营、使用快递服 务以及对快递市场实施监督管理， 适用本办法。第三条经营快递业务的企业 应当遵守法律法规和公序良俗，依 法节约资源、保护生态环境，为用 户提供迅速、准确、安全、方便的 快递服务。第四条两个以上经营快递业 务的企业使用统一的商标、字号、 快递运单及其配套的信息系统的， 应当签订书面协议，明确各自的权 利义务，遵守共同的服务约定，在 服务质量、安全保障、业务流程、 生态环保、从业人员权益保障等方 面实行统一管理。商标、字号、快递运单及其配套的 信息系统的归属企业，简称为总部 快递企业。笫五条用户使用快递服务应 当遵守法律、行政法规以及国务院 和国务院有关部门关于禁止寄递或 者限制寄递物品的规定，真实、准 确地向经营快递业务的企业提供使 用快递服务所必需的信息。Article5Theusersthatuseexpressdeliveryservicesshallcomplywithlaws,administrativeregulations,andprovisionsoftheStateCouncilandtherelevantdepartmentsoftheStateCouncilonitemsprohibitedorrestrictedfromdelivery,andprovidetheenterprisesprovidingexpressdeliveryserviceswiththeinformationnecessaryfortheuseofexpressdeliveryservicesinatruthfulandaccuratemanner.Article6ThepostaladministrativedepartmentoftheStateCouncilshallberesponsibleforthesupervisionandadministrationofthenationalexpressdeliverymarket.Thepostaladministrativedepartmentofaprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentshallberesponsibleforthesupervisionandadministrationoftheexpressdeliverymarketwithinitsadministrativeregion.ThepostaladministrativedepartmentbelowtheprovinciallevelformedinaccordancewiththeprovisionsoftheStateCouncilshallberesponsibleforthesupervisionandadministrationoftheexpressdeliverymarketwithinitsjurisdiction.ThepostaladministrativedepartmentoftheStateCouncil,thepostaladministrativedepartmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment5andpostaladministrativedepartmentsbelowtheprovinciallevelarecollectivelyreferredtoas"postaladministrativedepartmentsn.Article7Thepostaladministrativedepartmentshallconductthesupervisionandadministrationoftheexpressdeliverymarketinanopenandimpartialmanner,encouragefaircompetition,supporthigh-qualitydevelopment,andstrengthenintegratedonlineandofflinesupervisionandadministration.Article8Expressdeliveryindustryorganizationsformedinaccordancewiththelawshallsafeguardthelawfulrightsandinterestsofenterprisesprovidingexpressdeliveryservices,expressdeliveryterminaloutlets,andexpressdeliverypractitioners,developexpressdeliveryindustrynormsandconventionsinaccordancewiththeprovisionsofapplicablelaws,regulations,andtheirbylaws,strengthenindustryself-regulation,andadvocatelawful,honest,safe,andgreenoperationsofenterprises.Article9Enterprisesprovidingexpressdeliveryservicesshalladheretogreenandlow-carbondevelopment
