消耗臭氧层物质管理条例（2010年4月8日中华人民共和 国国务院令第573号公布 根据 2018年3月19日国务院关于 修改和废止部分行政法规的决 定第一次修订根据2023年 12月29日国务院关于修改消耗臭氧层物质管理条例的 决定第二次修订）第一章总 则第一条为了加强对消耗臭 氧层物质的管理，履行保护臭 氧层维也纳公约和关于消耗 臭氧层物质的蒙特利尔议定书 规定的义务，保护臭氧层和生态消耗臭氧层物质管理条例(2023修订)RegulationontheAdministrationofOzoneDepletingSubstances(2023Revision)制定机关：国务院发文字号：中华人民共和国国务院令第770号公布日期:2023.12.29施行日期:2024.03.01效力住阶：行政法规法规类别：环保综合规定IssuingAuthority：StaleCouncilDocumentNumber：OrderNo.770oftheStateCouncilofthePeople'sRepublicofChinaDateIssued：12-29-2023EffectiveDate：03-01-20241.evelofAuthority：AdministrativeRegulationsAreaofLaw:GeneralProvisionsonEnvironmentalProtectionRegulationontheAdministrationofOzoneDepletingSubstances(PromulgatedbyOrderNo.573oftheStateCouncilofthePeople'sRepublicofChinaonApril8,2010;revisedforthefirsttimeinaccordancewiththeDecisionoftheStateCouncilonAmendingSomeAdministrativeRegulationsonMarch19,2018;andrevisedforthesecondtimeinaccordancewiththeDecisionoftheStateCounciltoAmendtheRegulationontheAdministrationofOzonedepletingSubstancesonDecember29,2023)ChapterIGeneralProvisionsArticle1Tostrengthentheadministrationofozonedepletingsubstances,fulfilltheobligationsoftheViennaConventionfortheProtectionoftheOzoneLayerandtheMotrealProtocolonSubstancesthatDepletetheOzone1.ayer,protecttheozonelayerandeco-environmet,andmaintainpeople'shealth,thisRegulationisformulatedpursuanttotheAirPollutionPreventionandControlLawofthePeople'sRepublicofChina.Article2ForthepurposeofthisRegulation,tozone-depletingsubstances*meanschemicalsincludedintheListofControlledOzonedepletingSubstancesinChina.TheListofControlledOzone-depletingSubstancesinChinashallbedeveloped,adjusted,andpublishedbythedepartmentofecologyandenvironmentoftheStateCouncilinconjunctionwithappropriatedepartmentsoftheStateCouncil.Article3ThisRegulationshallapplytotheproduction,sales,consumptionandimport/exportofozonedepletingsubstancesinsidethePeople'sRepublicofChina.Theterm,*productionasmentionedintheprecedingparagraphreferstotheproducingactivitiesofozonedepletingsubstances.ThetermUconsumptionasmentionedintheprecedingparagraphreferstotheuseofozonedepletingsubstancesforproductionsandbusinessoperations,excludingtheuseofproductscontainingozonedepletingsubstances.环境，保障人体健康，根据中 华人民共和国大气污染防治 法，制定本条例。第二条 本条例所称消耗臭 氧层物质，是指列入中国受控 消耗臭氧层物质清单的化学 品O中国受控消耗臭氧层物质清 单由国务院生态环境主管部门 会同国务院有关部门制定、调整 和公布。第三条在中华人民共和国 境内从事消耗臭氧层物质的生 产、销售、使用和进出口等活 动，适用本条例。前款所称生产，是指制造消耗臭 氧层物质的活动。前款所称使 用，是指利用消耗臭氧层物质进 行的生产经营等活动，不包括使 用含消耗臭氧层物质的产品的活 动。第四条 消耗臭氧层物质的 管理工作应当坚持中国共产党的 领导，贯彻党和国家路线方针政 策和决策部署。Article4Theadministrationofozone-depletingsubstancesshalladheretotheleadershipoftheCommunistPartyofChina(CPC)andimplementtheguidelines,policies,decisions,andarrangementsoftheCPCandthestate.ThedepartmentofecologyandenvironmentoftheStateCouncilshallbeuniformlyresponsibleforthesupervisionandadministrationofozonedepletingsubstancesnationwide.ThecommercedepartmentoftheStateCouncil,theGeneralAdministrationofCustoms,andotherappropriatedepartmentsshallberesponsibleforthesupervisionandadministrationofozone-depletingsubstancesinaccordancewiththeprovisionsofthisRegulationandtheirrespectiveduties.Thedepartmentsofecologyandenvironmentandcommerceandotherappropriatedepartmentsoflocalpeople'sgovernmentsshall,inaccordancewiththeprovisionsofthisRegulationandtheirrespectiveduties,beresponsibleforthesupervisionandadministrationofozone-depletingsubstancesintheirrespectiveadministrativeregions.Article5Thestatewillgraduallyreduceozonedepletingsubstancesusedasrefrigerants,foamingagents,extinguishingagents,solvents,detergents,processingagents,pesticides,aerosolsandexpansionagentstilltheyarefinallyeliminated.Ozone-depletingsubstanceswhichhavebeeneliminatedbythestateshallnotbeusedforthepurposesprescribedintheprecedingparagraph.国务院生态环境主管部门统一负 责全国消耗臭氧层物质的监督管 理工作。国务院商务主管部门、海关总署 等有关部门依照本条例的规定和 各自的职责负责消耗臭氧层物质 的有关监督管理工作。地方人民政府生态环境主管部门 和商务等有关部门依照本条例的 规定和各自的职责负责本行政区 域消耗臭氧层物质的有关监督管 理工作。第五条国家逐步削减并最 终淘汰作为制冷剂、发泡剂、灭 火剂、溶剂、清洗剂、加工助 剂、杀虫剂、气雾剂、膨胀剂等 用途的消耗臭氧层物质。禁止将国家已经淘汰的消耗臭氧 层物质用于前款规定的用途。国务院生态环境主管部门会同国 务院有关部门拟订中国履行 关于消耗臭氧层物质的蒙特利 尔议定书国家方案（以下简ThedepartmentofecologyandenvironmentoftheStateCouncilshall,inconjunctionwiththeappropriatedepartmentsoftheStateCouncil,drafttheNationalPlanforChinatoImplementtheMontrealProtocolonSubstancesthatDepletetheOzoneLayer(the"NationalPlan")andimplementitupontheapprovaloftheStateCouncil.Article6ThedepartmentofecologyandenvironmentoftheStateCouncilshall,togetherwithotherrelevantdepartmentsundertheStateCouncil,basedontheNationalPlanandtheeliminationprogressofozonedepletingsubstances,determineandpublishacategoryofconstructionprojectsproducingorconsumingozonedepletingsubstanceswhosebuilding,rebuildingorexpansionisrestrictedorprohibited,andmakeandpublishacategoryofozonedepletingsubstanceswhoseproduction,consumptionorimport/exportisrestrictedorprohibited.Anypartythatneedstoproduceorconsumeforspecialpurposesanyozonedepletingsubstanceswhoseproductionorconsumptionisprohibitedunder
