废旧金属收购业治安管理办法（1994年1月5日国务院批准 1994年1月25日公安部令第16 号发布 根据2023年7月20日国务院关于修改和废止部分行 政法规的决定修订）第一条为了加强对废旧金 属收购业的治安管理，保护合法 经营，预防和打击违法犯罪活 动，制定本办法。第二条 本办法所称废旧金废旧金属收购业治安管理办法(2023修订)MeasuresforthePublicSecurityAdministrationoftheScrapMetalCollectionIndustry(2023Revision)制定机关：国务院发文字号：中华人民共和国国务院令第764号公布日期：2023.07.20施行日期：2023.07.20效力位阶：行政法规法规类别：治安管理物资管理IssuingAuthority：StaleCouncilDocumentNumber：OrderNo.764oftheStateCouncilofthePeople'sRepublicofChinaDateIssued：07-20-2023EffectiveDate：07-20-20231.evelofAuthority：AdministrativeRegulationsAreaofLaw:PublicSecurityAdministrationMaterialsAdministrationMeasuresforthePublicSecurityAdministrationoftheScrapMetalCollectionIndustry(AsapprovedbytheStateCouncilonJanuary5,1994,issuedbyOrderNo.16oftheMinistryofPublicSecurityonJanuary25,1994,andrevisedbytheDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonJuly20,2023)Article1TheseMeasuresaredevelopedforthepurposeofstrengtheningthepublicsecurityadministrationofthescrapmetalcollectionindustry,protectinglawfulbusinessoperations,andpreventingandcrackingdownonillegalandcriminalactivities.Article2ForthepurposesoftheseMeasures,scrapmetalsmeansproductivescrapmetalsandnonproductivescrapmetals.Thespecificclassificationofproductivescrapmetalsandnon-productivescrapmetalsshallbeprovidedforbytheMinistryofPublicSecurityinconjunctionwiththerelevantdepartments.Article3Productivescrapmetalsshall,inaccordancewiththeapplicableprovisionsoftheStateCouncil,becollectedbyenterpriseshavingtherighttoconductbusinessoperationsintheproductivescrapmetalcollectionindustry.Otherenterprisesandindividualindustrialandcommercialhouseholdscollectingscrapmetalsmayonlycollectnon-productivescrapmetals,andmaynotcollectproductivescrapmetals.Article4Anenterpriseoranindividualindustrialandcommercialhouseholdcollectingscrapmetalsshall,within15daysofobtainingitsbusinesslicense,undergorecordationformalitieswiththepublicsecurityauthorityofthepeople'sgovernmentofthecountyorequivalentwhereitislocated.Ifanyrecordationmatterchanges,theenterpriseorindividualindustrialandcommercialhouseholdcollectingscrapmetalsshall,within15daysofthechange(orwithin15daysofmodificationofindustrialandcommercialregistrationifitisamatterofindustrialandcommercialregistration),undergomodificationformalitieswiththepublicsecurityauthorityofthepeople'sgovernmentofthecountyorequivalent.属，是指生产性废旧金属和非生 产性废旧金属。生产性废旧金属 和非生产性废旧金属的具体分类 由公安部会同有关部门规定。第三条生产性废旧金属， 按照国务院有关规定由有权经营 生产性废旧金属收购业的企业收 购。收购废旧金属的其他企业和 个体工商户只能收购非生产性废 旧金属，不得收购生产性废旧金 属O第四条收购废旧金属的企 业和个体工商户，应当在取得营 业执照后15日内向所在地县级人 民政府公安机关备案。备案事项发生变更的，收购废旧 金属的企业和个体工商户应当自 变更之日起15日内（属于工商登 记事项的自工商登记变更之日起 15日内）向县级人民政府公安机 关办理变更手续。公安机关可以通过网络等方式, 便利企业和个体工商户备案。Thepublicsecurityauthoritiesmay,byonlineandothermeans,facilitatetherecordationofenterprisesandindividualindustrialandcommercialhouseholds.Article5Anenterprisecollectingscrapmetalsshallhaveafixedbusinesspremise.Anindividualindustrialandcommercialhouseholdcollectingscrapmetalsshallhavealocallyregisteredpermanentresidenceortemporaryresidence.Article6Nocollectionstationshallbesetupneararailway,miningarea,oilfield,port,airport,constructionsite,militaryrestrictedzone,ormetalsmeltingandprocessingenterpriseforthecollectionofscrapmetals.Article7Anenterprisecollectingscrapmetalsshallcheckthecertificateissuedbytheseller,andtruthfullyregisterthenameoftheseller,thename,address,andidentificationnumberofthehandlingperson,andthenames,quantity,specifications,andconditionsoftheitemsduringthecollectionofproductivescrapmetals.Article8Anenterpriseoranindividualindustrialandcommercialhouseholdcollectingscrapmetalsmaynotcollectthefollowingmetalitems:(1) Guns,ammunition,andexplosives.(2) Highlytoxic,radioactivesubstancesandrelatedcontainers.(3) Specialmeansforrailways,oilfields,powersupply,telecommunication,mining,waterconservancy,surveyingandurbanutilities.第五条收购废旧金属的企 业应当有固定的经营场所。收购 废旧金属的个体工商户应当有所 在地常住户口或者暂住户口。第六条在铁路、矿区、油 田、港口、机场、施工工地、军 事禁区和金属冶炼加工企业附 近，不得设点收购废旧金属。第七条收购废旧金属的企 业在收购生产性废旧金属时，应 当查验出售单位开具的证明，对 出售单位的名称和经办人的姓 名、住址、身份证号码以及物品 的名称、数量、规格、新旧程度 等如实进行登记。第八条收购废旧金属的企 业和个体工商户不得收购下列金 属物品：(-)枪支、弹药和爆炸物品;(二)剧毒、放射性物品及其容 器；()铁路、油田、供电、电信 通讯、矿山、水利、测量和城市 公用设施等专用器材；(四)公安机关通报寻查的赃物 或者有赃物嫌疑的物品。(4) Stolenorsuspectedstolenitemsthatarebeingsearchedbyapublicsecurityauthoritythroughanannouncement.Article9Whereanenterpriseoranindividualindustrialandcommercialhouseholdcollectingscrapmetalsfindsanysaleofstolenorsuspectedstolenitemsthatarebeingsearchedbyapublicsecurityauthoritythroughanannouncement,itshallimmediatelyfileareportwiththepublicsecurityauthority.Thepublicsecurityauthorityshalldetainthestolenorsuspectedstolenitemsandissueareceipt.Thesuspectedstolenitemsshallbereturnedpromptlyiftheyarefoundnottobestolen;thestolenorsuspectedstolenitemsshallbedisposedofinaccordancewiththeapplicableprovisionsofthestateiftheyarefoundtobestolen.Article1()Apublicsecurityauthorityshallguideandinspectthepublicsecuritybusinessofenterprisesorindividualindustria
