【发文字号】 【公布日期】 【施行日期】 【效力位阶】 【法规类别】缺陷汽车产品召回管理条 例实施办法（2015年11月27日国家 质量监督检验检疫总局令 第176号公布，根据2020 年10月23日国家市场监督 管理总局令第31号修订）第一章总则第一条根据缺陷 汽车产品召回管理条例， 制定本办法。第二条在中国境内 生产、销售的汽车和汽车挂 车（以下统称汽车产品）的 召回及其监督管理，适用本缺陷汽车产品召回管理条例实施办法(2020修订)MeasuresfortheImplementationoftheRegulationontheAdministrationoftheRecallofDefectiveAutoProducts(2020Revision)国家市场监督管理总局令第31号2020.10.232020.10.23部门规章产品质量监督Issuingauthority：InstrumentalitiesoftheStateCouncil,A11Administrations,StateAdministrationforMarketRegulationDocumentNumber：OrderNo.31oftheStateAdministrationforMarketRegulationDateissued：10-23-2020Effectivedate：10-23-20201.evelofAuthority：DepartmentalRulesAreaofLawsQualityControlandSupervisionMeasuresfortheImplementationoftheRegulationontheAdministrationoftheRecallofDefectiveAutoProducts(PromulgatedbyOrderNo.176oftheGeneralAdministrationofQualitySupervision,InspectionandQuarantineonNovember27,2015;revisedbyOrderNo.31oftheStateAdministrationforMarketRegulationonOctober23,2020)ChapterIGeneralProvisionsArticle 1 TheseMeasuresaredevelopedinaccordancewiththeRegulationontheAdministrationoftheRecallofDefectiveAutoProducts.Article 2 TheseMeasuresshallapplytotherecallofautosandautotrailers(hereinaftercollectivelyreferredtoastheuautoproductsn)whicharemanufacturedandsoldwithintheterritoryofChinaandthesupervisionandadministrationthereof.Article 3 Autoproductmanufacturers(hereinafterreferredtoas“manufacturers”)arethepartiesresponsiblefortherecallofdefectiveautoproducts.Wherethereisanydefectinitsautoproducts,amanufacturershallrecallsuchproductsinaccordancewiththeseMeasures.Article 4 TheStateAdministrationforMarketRegulation(theuSAMRn)shallberesponsibleforthesupervisionandadministrationoftherecallofdefectiveautoproductsnationwide.办法。Article 5 TheSAMRmay,asneededforwork,authorizeprovincialmarketregulatorydepartmentstoberespectivelyresponsibleforpartoftheworkonthesupervisionandadministrationoftherecallofdefectiveautoproductswithintheirrespectiveadministrativeregions.ThedefectiveproductrecalltechnicalinstitutionoftheSAMR(hereinafterreferredtoastheurecalltechnicalinstitutionn)shallassumethespecifictechnicaltasksoninformationmanagement,defectinvestigationandrecallmanagementconcernedintherecallofdefectiveautoproductsinaccordancewiththeSAMRprovisions.ChapterIlInformationManagementArticle 6 Allentitiesandindividualsshallhavetherighttofilecomplaintsaboutpotentialdefectsinautoproductsandotherproblemswithmarketregulatorydepartments.第三条汽车产品生 产者（以下简称生产者）是 缺陷汽车产品的召回主体。 汽车产品存在缺陷的，生产 者应当依照本办法实施召 回。第四条国家市场监 督管理总局（以下简称市场 监管总局）负责全国缺陷汽 车产品召回的监督管理工 作。第五条市场监管总 局根据工作需要，可以委托 省级市场监督管理部门在 本行政区域内负责缺陷汽 车产品召回监督管理的部 分工作。市场监管总局缺陷产品召 回技术机构（以下简称召回 技术机构）按照市场监管总 局的规定承担缺陷汽车产 品召回信息管理、缺陷调 查、召回管理中的具体技术 工作。第二章信息管理第六条任何单位和 个人有权向市场监督管理 部门投诉汽车产品可能存 在的缺陷等有关问题Q第七条市场监管总 局负责组织建立缺陷汽车Article 7 TheSAMRshallberesponsiblefororganizingtheestablishmentofadefectiveautoproductrecallinformationmanagementsystemtocollect,summarize,analyzeandprocessinformationondefectiveautoproducts,filethemanufacturerinformationforrecordation,andreleaseinformationondefectiveautoproductsandtherecallthereof.TheSAMRshallberesponsiblefor,jointlywiththerelevantdepartmentsoftheStateCouncil,establishingamechanismforsharinginformationonthemanufacturing,sale,import,registration,inspection,maintenance,accident,consumercomplaintsandrecall,amongothers,ofautoproducts.Article 8 Amarketregulatorydepartmentthatfindsanyinformationondefectiveautoproductswithinitsadministrativeregionshallreportsuchinformationtohigherauthoritieslevelbylevel.Article 9 Manufacturersshallestablishandimprovetheirtraceabilityinformationmanagementsystemsforautoproductstoensurethattheycandeterminethedefectiveautoproductstoberecalledandnotifytheautoownersconcernedinatimelymanner.Article 10 Manufacturersshallpreservethefollowinginformationonthedesign,manufacturing,labeling,inspectionandotheraspectsofautoproducts:(1) Relevantdocumentsonthedesign,manufacturing,labelingandinspectionofautoproductsandrelevantqualitycontrolinformation.(2) Informationonthemanufacturersofthesafety-relatedpartsofautoproductsandthedesign,manufacturingandinspectionofautoparts.产品召回信息管理系统，收 集汇总、分析处理有关缺陷 汽车产品信息，备案生产者 信息，发布缺陷汽车产品信 息和召回相关信息。市场监管总局负责与国务 院有关部门共同建立汽车 产品的生产、销售、进口、 登记检验、维修、事故、消 费者投诉、召回等信息的共 享机制。第八条市场监督管 理部门发现本行政区域内 缺陷汽车产品信息的，应当 将信息逐级上报。第九条生产者应当 建立健全汽车产品可追溯 信息管理制度，确保能够及 时确定缺陷汽车产品的召 回范围并通知车主。第十条生产者应当 保存以下汽车产品设计、制 造、标识、检验等方面的信 息：（一）汽车产品设计、制造、 标识、检验的相关文件和质 量控制信息；（二）涉及安全的汽车产品 零部件生产者及零部件的 设计、制造、检验信息；（三）汽车产品生产批次及(3) Informationontheproductionbatchesofautoproductsandinformationontechnicalchanges.(4) Otherrelevantinformation.Manufacturersshallalsopreservethenames,validcertificatenumbers,contactaddresses,telephonenumbers,purchasedates,vehicleidentificationcodesandotherinformationofcarownersconcernedintheinitialsaleofautoproducts.Article 11 ManufacturersshallfilethefollowinginformationwiththeSAMR:技术变更信息;(1) Basicinformationonmanufacturers.(2) Informationonthetechnicalparametersofauto
