强制性国家标准管理办法MeasuresfortheAdministrationofMandatoryNationalStandards制定机关：国家市场监督管理总局发文字号：国家市场监督管理总局令第25号公布日期：2020.01.06施行日期:2020.06.01效力位阶：部门规章法规类别：法规规章制定与发布国家标准管理IssuingAuthority：StateAdministrationfbrMarketRegulationDocumentNumber：OrderNo.25oftheStateAdministrationforMarketRegulationDateIssued：01-06-2020EffectiveDate:06-01-20201.evelofAuthority：DepartmentalRulesAreaofLaw:FormulationandPromulgationofRegulationsandRulesAdministrationofNationalStandards国家市场监督管理总局令（第25号）OrderoftheStateAdministrationforMarketRegulation(No.25)强制性国家标准管理办法已于 2019年12月13日经国家市场监督管 理总局2019年第16次局务会议审议 通过，现予公布，自2020年6月1 日起施行。TheMeasuresfortheAdministrationofMandatoryNationalStandards,asdeliberatedandadoptedatthe16thexecutivemeetingin2019oftheStateAdministrationforMarketRegulationonDecember13,2019,areherebyissuedandshallcomeintoforceonJune1,2020.局长：肖亚庆Director:XiaoYaqing2020年1月6日January6,2020MeasuresfortheAdministrationofMandatoryNationalStandards(IssuedbyOrderNo.25oftheStateAdministrationforMarketRegulationonJanuary6,2020)Article1TheseMeasuresaredevelopedinaccordancewiththeStandardizationLawofthePeople'sRepublicofChinaforthepurposesofstrengtheningtheadministrationofmandatorynationalstandardsandregulatingthedevelopment,implementation,andsupervisionofmandatorynationalstandards.Article2TheseMeasuresshallapplytothedevelopment(includingprojectproposing,projectinitiation,drafting,requestforcomments,technicalreview,publicnotification,numbering,andissuanceapproval),organizationandimplementation,andsupervisionofmandatorynationalstandards.Article3Mandatorynationalstandardsshallbedevelopedfortechnicalrequirementsthatprotecthumanhealthandlifeandpropertysafety,safeguardnationalsecurityandenvironmentalsafety,andthatmeetthebasicneedsofeconomicandsocialadministration.强制性国家标准管理办法（2020年1月6日国家市场监督管理 总局令第25号公布）第一条为了加强强制性国家标 准管理，规范强制性国家标准的制 定、实施和监督，根据中华人民共 和国标准化法，制定本办法。第二条强制性国家标准的制定 （包括项目提出、立项、组织起草、 征求意见、技术审查、对外通报、编 号、批准发布）、组织实施以及监督 工作，适用本办法。第三条对保障人身健康和生命 财产安全、国家安全、生态环境安全 以及满足经济社会管理基本需要的技 术要求，应当制定强制性国家标准。第四条 制定强制性国家标准应 当坚持通用性原则，优先制定适用于 跨领域跨专业的产品、过程或者服务 的标准。Article4Inthedevelopmentofmandatorynationalstandards,theprincipleofuniversalityshallbeadheredto,withprioritygiventothedevelopmentofstandardsapplicabletotheproducts,processesorservicesacrossdifferentfieldsanddisciplines.Article5Thedevelopmentofmandatorynationalstandardsshallentailanin-depthinvestigationanddemonstrationonthebasisofscientificandtechnologicalresearchachievementsandexperiencefromsocialpracticestoensurethatthestandardsaredevelopedinascientific,normativeandtimelymanner.Article6Inthedevelopmentofmandatorynationalstandards,internationalstandardsshallbeadoptedinlightofnationalconditions.Article7Thedevelopmentofmandatorynationalstandardsshallbeopenandtransparent,andvariousmethodsshallbeadoptedundertheprincipleofconvenienceandeffectivenesstoaskallpartiesfortheiropinions.Article8Thereshallbeaspecificdepartmentresponsibleforsupervisingandadministeringtheimplementationofmandatorynationalstandards,whichmaydealwithanyviolationofmandatorynationalstandardsinaccordancewiththeprovisionsoflaws,administrativeregulationsordepartmentalrules.第五条制定强制性国家标准应 当在科学技术研究成果和社会实践经 验的基础上，深入调查论证，保证标 准的科学性、规范性、时效性。第六条 制定强制性国家标准应 当结合国情采用国际标准。第七条制定强制性国家标准应 当公开、透明，按照便捷有效的原则 采取多种方式，广泛听取各方意见。第八条强制性国家标准应当有 明确的标准实施监督管理部门，并能 够依据法律、行政法规、部门规章的 规定对违反强制性国家标准的行为予 以处理。第九条 国务院标准化行政主管 部门统一管理全国标准化工作，负责 强制性国家标准的立项、编号和对外 通报。国务院有关行政主管部门依据 职责负责强制性国家标准的项目提 出、组织起草、征求意见和技术审Article9TheadministrativedepartmentforstandardizationundertheStateCouncilshalladministerstandardizationacrossthecountryinacentralizedway.Itshallberesponsiblefortheprojectinitiation,numbering,andpublicnotificationofmandatorynationalstandards.TherelevantadministrativedepartmentsundertheStateCouncilshall,accordingtotheirrespectivefunctions,beresponsibleforprojectproposing,projectinitiation,drafting,requestforcomments,andtechnicalreview.TheissuanceofmandatorynationalstandardsshallbeapprovedbytheStateCouncilortheapprovalthereofshallbeauthorizedbytheStateCouncil.Theadministrativedepartmentsforstandardizationandtherelevantadministrativedepartmentsunderthepeople,sgovernmentsatorabovethecountylevelshall,accordingtotheirstatutoryfunctions,superviseandinspecttheimplementationofmandatorynationalstandards.Article10Theadministrativedepartmentforstandardizationofaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentmayproposetheinitiationofamandatorynationalstandardprojecttotheadministrativedepartmentforstandardizationundertheStateCouncil,whichshall,alongwiththerelevantadministrativedepartmentsundertheStateCouncil,studyanddecideonsuchproposal.Ifthedevelopmentofmandatorynationalstandardsisindeedrequired,theadministrativedepartmentforstandardizationundertheStateCouncilshallgiveexplicitinstructionstotheprojectproposingdepartment;ifnoprojectinitiationisrequired,reasonsshallbeexplained.查。强制性国家标准由国务院批准发 布或者授权批准发布。县级以上人民政府标准化行政主管部 门和有关行政主管部门依据法定职 责，对强制性国家标准的实施进行监 督检查。第十条省、自治区、直辖市人 民
