防治船舶污染海洋环境管理条例(2018修订)RegulationonthePreventionandControlofVessel-inducedPollutiontotheMarineEnvironment(2018Revision)制定机关：国务院发文字号：中华人民共和国国务院令第698号公布日期：2018.03.19施行日期：2018.03.19效力位阶：行政法规法规类别：污染防治环保综合规定IssuingAuthority：StateCouncilDocumentNumber:OrderNo.698oftheStateCouncilofthePeople'sRepublicofChinaDateIssued：03-19-2018EffectiveDate：03-19-20181.evelofAuthority：AdministrativeRegulationsAreaofLaw：PollutionPreventionGeneralProvisionsonEnvironmentalProtectionRegulationonthePreventionandControlofVessel-inducedPollutiontotheMarine防治船舶污染海洋环境管理条例Environment(2009年9月9日中华人民共 和国国务院令第561号公布根 据2013年7月18日国务院关 于废止和修改部分行政法规的决 定第一次修订 根据2013年 12月7日国务院关于修改部 分行政法规的决定第二次修订 根据2014年7月29日国务院 关于修改部分行政法规的决定 第三次修订 根据2016年2月 6 0国务院关于修改部分行政 法规的决定第四次修订根据(PromulgatedbytheOrderNo.561oftheStateCouncilofthePeople'sRepublicofChinaonSeptember9j2009;revisedforthefirsttimeaspertheDecisionoftheStateCouncilonAppealingandAmendingSomeAdministrativeRegulationsonJuly18,2013;revisedforthesecondtimeaspertheDecisionoftheStateCouncilonAmendingSomeAdministrativeRegulationsonDecember7,2013;revisedforthethirdtimeaspertheDecisionoftheStateCouncilonAmendingSomeAdministrativeRegulationsonJuly29,2014;andrevisedforthefourthtimeaspertheDecisionoftheStateCouncilonAmendingSomeAdministrativeRegulationsonFebruary6,2016;amendedforthefifthtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonMarch1,2017;andrevisedforthesixthtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonMarch19,2018.)ChapterIGeneralProvisionsArticle1ThisRegulationisformulatedinaccordancewiththeMarineEnvironmentalProtectionLawofthePeople'sRepublicofChinaforthepurposeofpreventingandcontrollingthepollutioncausedbyvesselsandtherelevantoperationstothemarineenvironment.Article2ThisRegulationshallapplytothepreventionandcontrolofpollutioncausedbyvesselsandtherelevantoperationstotheseaareasofthePeople'sRepublicofChina.Article3Thepreventionandcontrolofthepollutioncausedbyvesselsandtherelevantoperationstothemarineenvironmentshallobservetheprincipleofgivingprioritytopreventionandcombiningpreventionwithcontrol.2017年3月1日国务院关于 修改和废止部分行政法规的决 定第五次修订 根据2018年 3月19日国务院关于修改和 废止部分行政法规的决定第六 次修订）第一章总 则第一条为了防治船舶及其 有关作业活动污染海洋环境，根 据中华人民共和国海洋环境保 护法，制定本条例。第二条 防治船舶及其有关 作业活动污染中华人民共和国管 辖海域适用本条例。第三条防治船舶及其有关 作业活动污染海洋环境，实行预 防为主、防治结合的原则。第四条国务院交通运输主 管部门主管所辖港区水域内非军 事船舶和港区水域外非渔业、非 军事船舶污染海洋环境的防治工 作。Article4ThetransportadministrativedepartmentundertheStateCouncilshalltakechargeofthepreventionandcontrolofthepollutiontothemarineenvironmentcausedbyno-militaryvesselsinsidetheharborwatersunderitsjurisdictionandbynon-fishingvesselsandnon-militaryvesselsoutsidetheharborwatersunderitsjurisdiction.Themaritimeadministrativeinstitutionsshall,inaccordancewiththisRegulation,beresponsibleforthespecificsupervisionandadministrationofthepreventionandcontrolofthepollutioncausedbyvesselsandtherelevantoperationstothemarineenvironment.Article5ThetransportadministrativedepartmentundertheStateCouncilshall,undertherequirementsforpreventionandcontrolofthepollutioncausedbyvesselsandtherelevantoperationstothemarineenvironment,organizethepreparationoftheplanningfortheconstructionoftheemergencyresponsecapacityofpreventingandcontrollingthepollutioncausedbyvesselsandtherelevantoperationstothemarineenvironment,whichshallbepromulgatedandimplementeduponapprovalbytheStateCouncil.Thecoastallocalpeople'sgovernmentsatandabovethelevelofcitiesdividedintodistrictsshall,accordingtotheplanningfortheconstructionoftheemergencyresponsecapacityofpreventingandcontrollingthepollutioncausedbyvesselsandtherelevantoperationstothemarineenvironmentwhichisapprovedbytheStateCouncilandinlightofthelocalactualities,organizethepreparationofthecorrespondingplanningfortheconstructionoftheemergencyresponsecapacityofpreventingandcontrollingthepollutioncausedbyvesselsandtherelevantoperationstothemarineenvironment.海事管理机构依照本条例规定具 体负责防治船舶及其有关作业活 动污染海洋环境的监督管理。第五条 国务院交通运输主 管部门应当根据防治船舶及其有 关作业活动污染海洋环境的需 要，组织编制防治船舶及其有关 作业活动污染海洋环境应急能力 建设规划，报国务院批准后公布 实施。沿海设区的市级以上地方人民政 府应当按照国务院批准的防治船 舶及其有关作业活动污染海洋环 境应急能力建设规划，并根据本 地区的实际情况，组织编制相应 的防治船舶及其有关作业活动污 染海洋环境应急能力建设规划。第六条国务院交通运输主 管部门、沿海设区的市级以上地 方人民政府应当建立健全防治船 舶及其有关作业活动污染海洋环 境应急反应机制，并制定防治船 舶及其有关作业活动污染海洋环Article6ThetransportadministrativedepartmentundertheStateCouncilandthecoastallocalpeople'sgovernmentsatandabovethelevelofcitiesdividedintodistrictsshallestablishandimproveemergencyresponsemechanismsforpreventingandcontrollingthepollutioncausedtothemarineenvironmentby境应急预案。vesselsandrelevantoperations,andformulatecontingencyplansforpreventingandcontrollingthepollutioncausedtothemarineenvironmentbyvesselsandrelevantoperations.Article7Themaritimeadministrativeinstitutionsshall,jointlywiththeoceanicadministrativedepartments,establishandimprovethemonitoringandsurveillancemechanismsforthepollutioncausedtothemarineenvironmentbyvesselsandrelevantoperationsaccordingtotherequirementsforpreventingandc
