工贸企业有限空间作业安全规定ProvisionsontheSafetyofOperationsinConfinedSpacesofIndustryandTradeEnterprises制定机关：应急管理部发文字号：中华人民共和国应急管理部令第13号公布日期：2023.11.29施行日期：2024.01.01效力住阶：部门规章法规类别：劳动安全与劳动保护IssuingAuthority：MinistryofEmergencyManagementDocumentNumber：OrderNo.13oftheMinistryofEmergencyManagementofthePeople'sRepublicofChinaDaIeIssued：11-29-2023EffectiveDate：01-01-20241.evelofAuthority：DepartmentalRulesAreaofLaw:LabourSafetyandProtectionOrderoftheMinistryofEmergencyManagementofthePeople,sRepublicof中华人民共和国应急管理部令China(No. 13)（第13号）工贸企业有限空间作业安全规 定已经2023年11月6日应急管 理部第28次部务会议审议通过， 现予公布，自2024年1月1日起 施行。部长王祥喜2023年月29日TheProvisionsontheSafetyofOperationsinConfinedSpacesofIndustryandTradeEnterprises,asdeliberatedandadoptedatthe28thexecutivemeetingoftheMinistryofEmergencyManagementonNovember6,2023,areherebyissuedandshallcomeintoforceonJanuary1,2024.Minister:WangXiangxiNovember29,2023ProvisionsontheSafetyofOperationsinConfinedSpacesofIndustryandTrade工贸企业有限空间作业安全规定EnterprisesArticle1TheseProvisionsaredevelopedinaccordancewiththeWorkSafetyLawofthePeople'sRepublicofChinaandotherapplicablelawsandregulationsforthepurposesofensuringthesafetyofoperationsinconfinedspacesandpreventingandreducingworksafetyincidents.Article2TheseProvisionsshallapplytothesafetymanagementandsupervisionofoperationsinconfinedspacesofproductionandtradingentitiesinmetallurgy,nonferrousmetal,buildingmaterials,machinery,lightindustry,textiles,tobacco,commerceandtrade,andotherindustries(hereinaftercollectivelyreferredtoas“industryandtradeenterprises").Article3ForthepurposesoftheseProvisions,uconfinedspacenmeansaclosedorpartiallyclosedspacethatisnotdesignedasafixedworkplacewhereworkersmayentertoconductoperationsandwhichislikelytocausetheaccumulationoftoxic,hazardous,flammable,andexplosivesubstanceorinsufficientoxygencontent.ForthepurposesoftheseProvisions,“operationsinconfinedspacesmeansoperationsconductedbypersonnelinconfinedspaces.第一条为了保障有限空间作 业安全，预防和减少生产安全事 故，根据中华人民共和国安全生 产法等法律法规，制定本规定。第二条冶金、有色、建材、 机械、轻工、纺织、烟草、商贸等 行业的生产经营单位（以下统称工 贸企业）有限空间作业的安全管理 与监督，适用本规定。第三条本规定所称有限空 间，是指封闭或者部分封闭，未被 设计为固定工作场所，人员可以进 入作业，易造成有毒有害、易燃易 爆物质积聚或者氧含量不足的空 间。本规定所称有限空间作业，是指人 员进入有限空间实施的作业。第四条工贸企业主要负责人 是有限空间作业安全第一责任人， 应当组织制定有限空间作业安全管Article4Theprincipalpersoninchargeofanindustryandtradeenterpriseshallbetheprincipalpersoninchargeofworksafetyinconfinedspaces,organizeanddevelopmanagementrulesforworksafetyinconfinedspaces,specifythedutiesofthepersoninchargeoftheapprovalofoperationsinconfinedspaces,supervisors,andworkers,aswellastherequirementsforsafetytraining,operationapproval,protectivesupplies,emergencyrescueequipment,operatingprocedures,andemergencydisposal.Article5Anindustryandtradeenterpriseshallimplementrulesforthesupervisionofoperationsinconfinedspacesanddesignatefull-timeorpart-timesupervisorstotakechargeoftheimplementationofsafetymeasuresforoperationsinconfinedspaces.Supervisorsshallhavethesafetyknowledgeandemergencydisposalabilityappropriateforthesupervisionofoperationsinconfinedspacesandbeabletocorrectlyusesuppliesandequipmentforgasdetection,mechanicalventilation,respiratoryprotection,andemergencyrescue,amongothers.Article6Anindustryandtradeenterpriseshallidentifyconfinedspaces,establishaconfinedspacemanagementledgertospecifythequantityandlocationofconfinedspaces,hazardousfactors,andotherinformation,andupdatesuchinformationinatimelymanner.Anindustryandtradeenterpriseshallbeencouragedtoadoptinformation,digital,andintelligenttechnologiestoenhancethelevelofsafetyriskmanagementandcontrolinoperationsinconfinedspaces.理制度，明确有限空间作业审批 人、监护人员、作业人员的职责， 以及安全培训I、作业审批、防护用 品、应急救援装备、操作规程和应 急处置等方面的要求。第五条工贸企业应当实行有 限空间作业监护制，明确专职或者 兼职的监护人员，负责监督有限空 间作业安全措施的落实。监护人员应当具备与监督有限空间 作业相适应的安全知识和应急处置 能力，能够正确使用气体检测、机 械通风、呼吸防护、应急救援等用 品、装备。第六条 工贸企业应当对有限 空间进行辨识，建立有限空间管理 台账，明确有限空间数量、位置以 及危险因素等信息，并及时更新。鼓励工贸企业采用信息化、数字化 和智能化技术，提升有限空间作业 安全风险管控水平。第七条工贸企业应当根据有Article7Anindustryandtradeenterpriseshallspecifyapprovalrequirementsaccordingtothedegreeofsafetyrisksassociatedwithoperationsinconfinedspaces.Anyoperationinaconfinedspacewiththeriskofpoisoningandasphyxiationbyhydrogensulfide,carbonmonoxide,orcarbondioxide,amongothers,shallbesubjecttoapprovalbytheprincipalpersoninchargeoftheindustryandtradeenterpriseorbyanotherpersonentrustedtherebyinwriting,andtherelevantliabilityshallstillbebornebytheprincipalpersoninchargeoftheindustryandtradeenterpriseuponentrustment.Operationsinconfinedspacesshallnotbecarriedoutwithouttheapprovalofthepersoninchargeoftheapprovalofoperationsdesignatedbytheindustryandtradeenterprise.Article8Anindustryandtradeenterprisecontractingoutoperationsinconfinedspacestoanyotherentityinaccordancewiththelawshallagreeontheworksafetymanagementdutiesofeachpartywiththecontractorinthecontractoragreement.Theindustryandtradeenterpriseshalluniformlycoordinateandmanageoperationsinconfinedspaces,carryoutthesafetyinspectionsofon-siteoperations,andurgethecontractortoeffectivelyimplementvarioussafetymeasures.限空间作业安全风险大小，明确审 批要求
