Announcement of the Standing Committee of the People's Congress of Hainan Province(No. 17)The Several Provisions of the Hainan Free Trade Port on Punishments for Dishonest Acts Which Violate the System of Market Access upon Commitment, as adopted at the 7th session of the Standing Committee of the Seventh People's Congress of Hainan Province on November 24, 2023, are hereby issued and shall come into force on January 1,2024.Standing Committee of the People,s Congress of Hainan Province（第17号）海南省人民代表大会常务委员会November 24, 2023海南自由贸易港违反市场准入承诺即入制失信惩戒若干规定SeveralProvisionsoftheHainanFreeTradePortonPunishmentsforDishonestActsWhichViolatetheSystemofMarketAccessuponCommitment制定机关：海南省人大(含常委会)发文字号：海南省人民代表大会常务委员会公告第17号公布日期：2023.11.24施行日期：2024.01.01效力位阶：省级地方性法规法规类别：市场管理IssuingAuthority：HainanProvincePeople'sCongress(inci.StandingCommittee)DocumentNumber：AnnouncementNo.17oftheStandingCommitteeofthePeople'sCongressofHainanProvinceDateIssued：11-24-2023EffectiveDale:01-01-20241.evelofAuthority：ProvincialLocalRegulationsAreaofLaw:MarketManagement海南省人民代表大会常务委员会公告海南自由贸易港违反市场准入承诺即入制失信惩戒若干规定已由海南省第七届人民代表大会常务委员会第七次会议于2023年11月24日通过，现予公布，自2024年1月1日起施行Q2023年11月24日SeveralProvisionsoftheHainanFreeTradePortonPunishmentsforDishonestActsWhichViolatetheSystemofMarketAccessuponCommitment(Adoptedatthe7thsessionoftheStandingCommitteeoftheSeventhPeople'sCongressofHainanProvinceonNovember24,2023)Article1ForthepurposesofpreventingandpunishingseriouslydishonestactsthatviolatethesystemofmarketaccessuponcommitmentoftheHainanFreeTradePort,theseProvisionsaredevelopedinaccordancewiththeHainanFreeTradePortLawofthePeople'sRepublicofChina,theSocialCreditRegulationoftheHainanFreeTradePortandotherlawsandregulationsandrelevantprovisionsissuedbythestateandinlightoftheactualcircumstancesoftheHainanFreeTradePort.Article2Relevantdepartmentsofthepeople'sgovernmentsatorabovethecountylevelshall,accordingtotheirrespectivefunctions,conductcreditregulationofthebusinessesgovernedbythesystemofmarketaccessuponcommitment,andimposecredit-relatedpunishmentsfortheirseriouslydishonestactsinaccordancewiththelaw.海南自由贸易港违反市场准入承 诺即入制失信惩戒若干规定（2023年11月24日海南省第 七届人民代表大会常务委员会第 七次会议通过）第一条为了预防和惩戒违 反海南自由贸易港市场准入承诺 即入制的严重失信行为，根据 中华人民共和国海南自由贸易 港法海南自由贸易港社会信 用条例等法律、法规和国家有 关规定，结合海南自由贸易港实 际，制定本规定。第二条县级以上人民政府 有关部门应当按照各自职责对适 用市场准入承诺即入制的经营者 实施信用监管，依法对其严重失 信行为予以信用惩戒。第三条经营者违反市场准 入承诺即入制管理规定，有下列 情形之一的，由县级以上人民政 府有关部门将其列入市场准入承 诺即入制严重失信主体名单（以 下简称严重失信主体名单）：Article3Ifabusinessfallsunderanyofthefollowingcircumstancesinviolationoftheadministrativeprovisionsonthesystemofmarketaccessuponcommitment,therelevantdepartmentsofthepeople,sgovernmentatorabovethecountylevelshallincludeitorhiminthelistofseriouslydishonestpartiesthatviolatethesystemofmarketaccessuponcommitment(hereinafterreferredtoastheuIistofseriouslydishonestparties).(1) Itorhereceivesanyadministrativepunishmentforconductinginvestmentandbusinessactivitieswithoutundergoingtherecordationformalitiesorhavingtherecordationformalitiescompletedbasedonfalsematerialsandrefusingtotakecorrectiveactionafterbeingorderedtodosobytherelevantdepartment.(2) Itorhereceivesanyadministrativepunishmentforconductinginvestmentandbusinessactivitieswithoutsubmittingmaterialsduringaspecifiedperiodorbysubmittingmaterialsthatfailtomeettherequirementsandrefusingtotakecorrectiveactionafterbeingorderedtodosobytherelevantdepartment.(3) Itorheotherwiseviolatestheadministrativeprovisionsonthesystemofmarketaccessuponcommitment,andshallbeincludedinthelistofseriouslydishonestpartiesinaccordancewithlaws,regulationsandrelevantprovisionsissuedbythestate.Article4Therelevantdepartmentofapeople'sgovernmentatorabovethecountylevelshall,within20workingdaysfromthedatewhenitmakesadecisiontoincludearelevantbusinessinthelistofseriouslydishonestparties,publicizethelistofseriouslydishonestpartiesthroughCreditChina(Hainan)andtheNationalEnterpriseCreditInformationPublicitySystem(Hainan).（一）未办理备案或者提交虚假 材料办理备案开展投资经营活 动，经有关部门责令改正而拒不 改正，受到行政处罚的；（二）办理备案后，在约定的期 限内未提交材料或者提交的材料 不符合要求，开展投资经营活 动，经有关部门责令改正而拒不 改正，受到行政处罚的；（三）其他违反市场准入承诺即 入制管理规定，依照法律、法规 和国家有关规定应当列入严重失 信主体名单的。第四条 县级以上人民政府 有关部门应当自作出列入严重失 信主体名单决定之日起二十个工 作日内，将严重失信主体名单通 过信用中国（海南）、国家企业 信用信息公示系统（海南）向社 会公示。第五条 县级以上人民政府 有关部门对列入严重失信主体名 单的经营者实施以下失信惩戒措 施：Article5Relevantdepartmentsofthepeople'sgovernmentsatorabovethecountylevelshallimplementthefollowingpunishmentmeasuresagainstthebusinessesthatareincludedinthe(1) Prohibitingthebusinessesfromengagingthebusinessactivitiesinthefieldsinwhichtheyviolatethesystemofmarketaccessuponcommitment.(2) 1.istingthebusinessesasobjectsunderpriorityregulation,strengtheningroutineregulationandinspections,increasingtheproportionofrandominspectionsandthefrequencyofinspections,andconductingstrictregulationinaccordancewiththelaw.(3) Notapplyingfacilitativemeasuressuchasnotificationandcommitmentsysteminpublicadministrationandpublicservices.(4) Deductingcreditscoresanddegradingcreditratingsduringpublicresourcetrading.(5) Restri
