中华人民共和国母婴保健法实 施办法（2001年6月20日中华人民 共和国国务院令第308号公布 根据2017年11月17日国 务院关于修改部分行政法规的 决定第一次修订根据2022 年3月29日国务院关于修 改和废止部分行政法规的决 定第二次修订根据2023 年7月20日国务院关于修 改和废止部分行政法规的决 定第三次修订）第一章总 则第一条根据中华人民 共和国母婴保健法（以下简 称母婴保健法），制定本办 法。中华人民共和国母婴保健法实施办法(2023修订)MeasuresforImplementationoftheLawofthePeople,sRepublicofChinaonMaternalandInfantHealthCare(2023Revision)制定机关：国务院发文字号：中华人民共和国国务院令第764号公布日期：2023.07.20施行日期：2023.07.20效力位阶：行政法规法规类别：妇幼卫生IssuingAuthority:StateCouncilDocumentNumber：OrderNo.764oftheStateCouncilofthePeople'sRepublicofChinaDateIssued：07-20-2023EffectiveDate：07-20-20231.evelofAuthority:AdministrativeRegulationsAreaofLaw：MaternalandChildHealthMeasuresforImplementationoftheLawofthePeople'sRepublicofChinaonMaternalandInfantHealthCare(IssuedbyOrderNo.308oftheStateCouncilofthePeople,sRepublicofChinaonJune20,2001;revisedforthefirsttimeinaccordancewiththeDecisionoftheStateCouncilonAmendingSomeAdministrativeRegulationsissuedonNovember17,2017;revisedforthesecondtimeinaccordancewiththeDecisionoftheStateCouncilonAmendingandRepealingSomeAdministrativeRegulationsissuedonMarch29,2022;andrevisedforthethirdtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonJuly20,2023)ChapterIGeneralProvisionsArticle1TheseMeasuresaredevelopedinaccordancewiththeLawofthePeople,sRepublicofChinaonMaternalandInfantHealthCare(hereinafterreferredtoasthe“LawonMaternalandInfantHealthCaren).第二条在中华人民共和 国境内从事母婴保健服务活动 的机构及其人员应当遵守母婴 保健法和本办法。第三条母婴保健技术服 务主要包括下列事项：（一）有关母婴保健的科普宣 传、教育和咨询；Article2InstitutionsprovidingmaternalandinfanthealthcareservicesintheterritoryofthePeople'sRepublicofChinaandtheirstaffmembersshallcomplywiththeLawonMaternalandInfantHealthCareandtheseMeasures.Article3Thetechnicalservicesformaternalandinfanthealthcaremainlyincludethefollowing:(1)popularsciencedissemination,educationandconsultationofmaternalandinfanthealthcare;(2)pre-maritalmedicalexamination;（二）婚前医学检查；(3)prenataldiagnosisandgeneticdiseasediagnosis;（三）产前诊断和遗传病诊断；(4)skillsofmidwifery;（四）助产技术；(5)performanceofbirthcontrolsurgeryaccordingtomedicalneeds;（五）实施医学上需要的节育手术；(6)diseasescreeningfornewbornbabies;and（六）新生儿疾病筛查；(7)otherreproductivehealthcareserviceson（七）有关生育、节育、不育childbearing,birthcontrolandinfertility.的其他生殖保健服务。第四条公民享有母婴保 健的知情选择权。国家保障公 民获得适宜的母婴保健服务的 权利。第五条母婴保健工作以Article4Citizensshallhavetherighttolearnthetruthofandtochoosematernalandinfanthealthcare.Thestateshallguaranteecitizens*righttoreceiveappropriatematernalandinfanthealthcareservices.Article5Thematernalandinfanthealthcareshallfocusonhealthcareforthepurposeofsafeguardingreproductivehealth,andimplementthepolicyofcombininghealthcarewithclinictreatments,meetingtheneedsofvariousgroupsandtheneedsofcitizensatthegrass-rootslevel,andgivingprioritytoprevention.Article6Thepeople'sgovernmentsatalllevelsshallincludematernalandinfanthealthcareintheirplansforeconomicandsocialdevelopment,providenecessaryeconomic,technicalandmaterialconditionsforthedevelopmentofmaternalandinfanthealthcare,andgivespecialsupporttothematernalandinfanthealthcareinareasinhabitedbyethnicminoritiesandinpoverty-strickenareas.Thepeople'sgovernmentsatorabovethecountylevelmay,inlightoftheparticularconditionsandneedsoftheirrespectivelocalities,setupspecialfundforthedevelopmentofmaternalandinfanthealthcareundertaking.Article7ThehealthadministrativedepartmentundertheStateCouncilshallberesponsiblefortheworkofmaternalandinfanthealthcarethroughoutthecountry,andperformthefollowingduties:(1) DevelopingsupportingrulesandtechnicalnormsfortheLawonMaternalandInfantHealthCareandtheseMeasures.保健为中心，以保障生殖健康 为目的，实行保健和临床相结 合，面向群体、面向基层和预 防为主的方针Q第六条各级人民政府应 当将母婴保健工作纳入本级国 民经济和社会发展计划，为母 婴保健事业的发展提供必要的 经济、技术和物质条件，并对 少数民族地区、贫困地区的母 婴保健事业给予特殊支持。县级以上地方人民政府根据本 地区的实际情况和需要，可以 设立母婴保健事业发展专项资 金O第七条国务院卫生行政 部门主管全国母婴保健工作， 履行下列职责：（一）制定母婴保健法及本办 法的配套规章和技术规范；（二）按照分级分类指导的原 则，制定全国母婴保健工作发 展规划和实施步骤；(2) Developingnationaldevelopmentplanandimplementationproceduresforthematernalandinfanthealthcareundertheprincipleofhierarchicalandclassifiedguidance.(3)Organizingthepopularizationofappropriatetechnologiesformaternalandinfanthealthcareandotherreproductivehealthservices.（三）组织推广母婴保健及其他生殖健康的适宜技术；(4)Exercisingsupervisionovertheworkofmaternalandinfanthealthcare.（四）对母婴保健工作实施监督。Article8Thedepartmentsofpublicfinance,publicsecurity,civilaffairs,education,humanresourcesandsocialsecurityofthepeople,sgovernmentsatorabovecountylevelshall,withinthescopeoftheirrespectivefunctions,coordinateeffortswiththehealthadministrativedepartmentatthesamelevelsintheworkofmaternalandinfanthealthcare.第八条县级以上各级人民政府财政、公安、民政、教育、人力资源社会保障等部门应当在各自职责范围内，配合同级卫生行政部门做好母婴保健工作。ChapterIlPre-maritalHealthCare第二章婚前保健Article9ForthepurposesofArticle7oftheLawonMaternalandInfantHealthCare,thepremaritalhealthinstructionsincludethefollowing:第九条母婴保健法第七条所称婚前卫生指导，包括下列事项：(1)healthcareandeducationonsexualhygiene;（一）有关性卫生的保健和教育；(2)contraceptionandfamilyplanninginstructionsfornewly-marriedcoup
