上海市土壤污染防治条例RegulationsofShanghaiMunicipalityonSoilPollutionPreventionandControl制定机关：上海市人大(含常委会)发文字号：上海市人民代表大会常务委员会公告16届第6号公布日期：2023.07.25施行日期：2023.10.01效力位阶：省级地方性法规法规类别：污染防治IssuingAuthority：ShanghaiMunicipalityPeople'sCongress(incl.StandingCommittee)DocumentNumber：AnnouncementNo.6oftheStandingCommitteeofthe16thShanghaiMunicipalPeople'sCongressDateIssued：07-25-2023EffectiveDate：10-01-20231.evelofAuthority：ProvincialLocalRegulationsAreaofLaw：PollutionPreventionAnnouncementoftheStandingCommitteeof上海市人民代表大会常务委员会ShanghaiMunicipalPeople'sCongress公告No.6（十六届）第六号）上海市土壤污染防治条例已 由上海市第十六届人民代表大会 常务委员会第四次会议于2023 年7月25日通过，现予公布， 自2023年10月1日起施行。上海市人民代表大会常务委员会RegulationsofShanghaiMunicipalityonSoilPollutionPreventionandControlwereadoptedatthe4thSessionoftheStandingCommitteeofthe16thShanghaiMunicipalPeople,sCongressonJuly25,2023,areherebypromulgated.TheyshallbeeffectiveasofOctober1st,2023.StandingCommitteeoftheShanghaiMunicipalPeople'sCongressJuly 25, 20232023年7月25日RegulationsofShanghaiMunicipalityonSoilPollutionPreventionandControl(Adoptedatthe4thSessionoftheStandingCommitteeofthe16thShanghaiMunicipalPeople'sCongressonJuly25,2023)ChapterIGeneralProvisionsArticle1Withaviewtoprotectingandimprovingtheecologicalenvironment,preventingandcontrollingsoilpollution,safeguardingpublichealth,promotingpermanentuseofsoilresources,advancingthebuildingofecologicalcivilization,propellingsustainableandhigh-qualityeconomicandsocialdevelopment,andbuildingabeautifulShanghaiwherehumansandnaturecoexistinharmony,theseRegulationsareformulatedinaccordancewiththeSoilPollutionPreventionandControlLawofthePeople'sRepublicofChinaandotherrelevantlawsandadministrativerules,andinthelightoftheactualcircumstancesofthisMunicipality.Article2TheseRegulationsapplytothesoilpollutionpreventionandcontrolandrelevantactivitieswithintheadministrativeareaofthisMunicipality.上海市土壤污染防治条例（2023年7月25日上海市第十 六届人民代表大会常务委员会第 四次会议通过）第一章总则第一条为了保护和改善生 杰环境，防治土壤污染，保障公 众健康，推动土壤资源永续利 用，推进生态文明建设，促进经 济社会可持续、高质量发展，建 设人与自然和谐共生的美丽上 海，根据中华人民共和国土壤 污染防治法等有关法律、行政 法规，结合本市实际，制定本条 例。第二条本条例适用于本市 行政区域内的土壤污染防治及相 关活动。本条例所称土壤污染，是指因人 为因素导致某种物质进入陆地表 层土壤，引起土壤化学、物理、 生物等方面特性的改变，影响土 壤功能和有效利用，危害公众健 康或者破坏生态环境的现象。ForthepurposesoftheseRegulations,usoilpollutionnmeansthephenomenonofasubstance,sentryintothesoilsurfaceoftheearthcausedbyahumanfactor,thuscausingchangesinthechemical,physical,biologicalandotherpropertiesofthesoil,affectingthefunctionsandeffectiveuseofthesoil,andjeopardizingpublichealthordamagingtheecologicalenvironment.Article3Insoilpollutionpreventionandcontrol,theprinciplesoftheprimaryroleofprevention,priorityforprotection,categorizedadministration,riskmanagementandcontrol,liabilityforpollution,andpublicparticipationshallbeadheredto.ThisMunicipalityshallstrengthenoverallcoordinationbetweensoilpollutionpreventionandcontrolandatmospheric,water,solid-wastepollutionpreventionandcontrol,andachievepreventionatthesourcesofthepollutants.Inthelightoftheecologicalconditionsofthesoilandundergroundwater,thisMunicipalityshallimplementtheintegratedpreventionandcontrolofsoilpollutionandundergroundwaterpollution,formulateaunifiedplanfortherelevantwork,andmakeholisticadvances.Article4Allorganizationsorindividualsareobligatedtoprotectsoilandpreventsoilpollution.1.and-userightsholdersengagedintheactivitiesoflanddevelopmentandutilization,andenterprises,publicinstitutions,andotherproducersandoperatorsengagedinproductionandbusinessactivitiesshalltakeeffectivemeasurestopreventorreducesoilpollution,andassumeliabilityaccordingtolawforthesoilpollutiontheycause.第三条土壤污染防治应当 坚持预防为主、保护优先、分类 管理、风险管控、污染担责、公 众参与的原则。本市加强土壤污染防治与大气、 水、固体废物等污染防治的统筹 协同，实现源头预防。本市根据土壤和地下水生态环境 状况，实行土壤污染与地下水污 染一体防治，对相关工作实施一 体部署、一体推进。第四条任何组织和个人都 有保护土壤、防止土壤污染的义 务。土地使用权人从事土地开发利用 活动，企业事业单位和其他生产 经营者从事生产经营活动，应当 采取有效措施，防止、减少土壤 污染，对所造成的土壤污染依法 承担责任。第五条本市各级人民政府 应当对本行政区域土壤污染防治 和安全利用负责。Article5Thepeople,sgovernmentsatalllevelsofthisMunicipalityshallberesponsibleforsoilpollutionpreventionandcontrolandsafesoilutilizationwithintheadministrativeareaofthisMunicipality.ThisMunicipalityshallimplementatarget-orientedresponsibilitysystemandaperformanceassessmentandevaluationsystemforsoilpollutionpreventionandcontrol,andusetheperformanceinachievingsoilpollutionprevention/controltargetsasacriterionforassessingandevaluatingthepeople'sgovernmentsatalllevelsandtheleadersthereof,aswellasthedepartmentsresponsibleforthesupervisorymanagementofsoilpollutionpreventionandcontrolandtheleadersthereof.Article6Themunicipalanddistrictpeople'sgovernmentsshallstrengthentheirleadershipoversoilpollutionpreventionandcontrol,establishandimprovetheworkingmechanismforcomprehensivesupervisionofsoilpollutionpreventionandcontrol,andorganize,coordinateandurgerelevantdepartmentstoperformtheirdutiesofsupervisorymanagementofsoilpollutionpreventionandcontrolaccordingtothelaw.Town/townshippeople,sgovernmentsandsub-districtofficesshall,accordingtotheirduties,dowelltheworkofsoilpollutionpreventionandcontrol.
