2023ProcuratorialWhitePaperonIntellectualPropertyinShanghaiReleasedbyShanghaiPeople,sProcuratorateAstheintellectualproperty(hereinafterreferredtoastheTP'')isakeyelementofthenewqualityproductiveforces,theIPprotectionmustbestrengthenedindevelopmentofsuchforces.Atpresent,ShanghaiiswitnessingaccelerationofconstructionofaninternationalcenterfortechnologyandinnovationaswellasbuildingoftheIPprotectionhighlandandthatofaninternationalIPcentralcity.Theprocuratoratewillperformthehigh-qualityandhigh-efficiencyprocuratorialfunctionstoenablenewachievementsinIPprotectionsothatinnovativevigorcanbemotivatedandaninnovativeenvironmentcanbecreated.Today(April23),ShanghaiPeople'sProcuratorateholdsapressconferencetoreleasethe2023ProciiratoraiWhitePaperonIntellectualPropertyinShanghaiintheChineseandEnglishversion.Basedonananalysisofthecriminal,civil,administrative,public-interestIPlitigationcaseshandledbythepropcuratoratesinShanghaiin2023,westudynewchangesandtrendsoccurredintheIPdevelopmentandprotectiontosuggestcounter-measuresandrecommendationsonconsolidationofthecomprehensivejudicialIPprotectionwithaviewtoprovidingpowerfulprocuratorialguaranteeforcultivatinganddevelopingofthenewqualityproductiveforcesaswellasforse11ingtheinnovation-drivendevelopment.I.BasicSituationoftheIPCasesinShanghaiOVeraHSituation1. TheIP-infringementcrimeisapproachinghistoricalheightandapplicationofthecoercivemeasureswascontinuouslyoptimized.TheprocuratoratesinShanghaitookcognizanceofi,369IP-infringementcriminalcasesinvolving2,81()perpetrators:ThenumberftheIP-IntringcmenlCrimiIHcasesixIbe%unofIbenu11beofllG%elexaninali(MdarrvslandIhalofhccases(orexaminationandp<wcu(>on.Thesamebelow.in2023,including425casesforexaminationandarrestinvolving738perpetratorswherethenumberofcasesandthatofperpetratorsrose144.3%and123.0%respectivelyincomparisonwiththepreviousyear;aswellas944casesforexaminationandprosecutioninvolving2,072perpetratorswherethenumberofcasesandthatofperpetratorsrose53.2%and49.9%respectivelyincomparisonwiththepreviousyear.Thearrestrateofsuspectswasbasicallythesameasin2022inthattheProC1.IratoraIeSfocusedmoreonaccurateimplementationofthecriminalpolicyofcombiningleniencywithseverity,resultinginstabilizationofthearrestrateapprovedbytheprocuratorates.Theaveragehandlingtimeofthefirst-instanceIPpublicprosecutedcasesinShanghaiwas56.63daysin2023.29.5%wassubstantiallyoptimizedincomparisonwith2022.ComprehensiveexaminationoftheIPcaseswasstrengthened,leadingtoprosecutionof20personsonsuspicionoftheIPinfringementinothercriminalcases.Intermsoftheeffectivejudgmentsrenderedbythecourt,thosewhoweresentencedtominimumthree-yearfixed-termimprisonmentaccountedfor43.9%,indicatingstrengtheningoftheproperty-relatedpenalty.2. SignificantchangesintheIP-infringementcriminalstructure.Firstly,althoughthenumberofthetrademarkinfringementcasesstillrankedthetopincriminalcases,itsproportionfurtherdroppedto88.8%.Amongotherthings,therewere873casesofsellingcommoditywithcounterfeitregisteredtrademarksinvolving1,579perpetrators,rankingthetopinvarioustrademark-infringementcharges.Therewerealso298casesofcounterfeitingregisteredtrademarksinvolving744perpetratorsand45casesofillegalmanufactureandsalesofillegallyproducedregisteredtrademarksandlogosinvolving124perpetratorsSecondly,the"quantityrelativeratioofthecopyright-infringementcasesroseunanimously,accountingfor9.4%from5.3%in2022incriminalcases.Amongotherthings,therewere105casesofcopyrightinfringementinvolving261perpetrators,thenumberofwhichroseby1.8timesincomparisonwith2022.Therewere24casesofsalesofpiratecopiesinvolving46perpetrators,thenumberofwhichrosebyfivetimesincomparisonwith2022.Thirdly,casesofinfringementofbusinesssecretswereontherise,accountingfor1.8%incriminalcases.Therewere24casesofinfringementofbusinesssecretsinvolving56perpetrators,thenumberofwhichroseby60%incomparisonwith2022.ThefirstcaseofillegalspyingandprovisionofbusinesssecretsforoverseasorganizationswashandledinShanghaiasofimplementationoftheAmendments(XI)totheCriminal1.aw.Changesinthecriminalstructurewerecausedby,ononehand,frequentoccurrenceofnew-typecasessuchasthecopyrightandthebusinesssecretinfringementresultedfromincreasingdevelopmentintheneweconomyandhightechnology;ontheotherhand,improvementinthejudicialorgans'powerfullyprofessionalcapabilitiesofcrackingandhandlingofcasesaswellasgradualmanifestationofachievementsintheservicesforscienceandtechnologyinnovationcentersandtheculturalprosperityandinnovation.3. Deeperfulfillmentofthelegalsupervisionofthecriminalproceedings.Pre-interventioninthefrontendofhardcaseswasfullyimplementedaimingatthefeaturesoftheIP-infringementcriminalcases,i.e.easilyperishableevidenceandtimelinessofevidencecollection.Relyingonmechanismsincludingtheofficeofinvestigationsupervisionandcollaboration,wesupervisedregistrationof283casesaswellaspursuitandprosecutionof213perpetrators,72ofwhomweresentencedtominimumthree-yearfixed-termimprisonment.Transferof52casesonsuspicionoftheIPinfringementtothepolicebytheadministrativeauth
