NursesRegulation(2020Revision)DocumentNumber：OrderNo.726oftheStateCouncilofthePeople'sRepublicofChinaAreaofLawHealthInstitutionsandPersonnelEpidemicPreventionandControl1.evelofAuthority：AdministrativeRegulationsIssuingAuthority：StateCouncilDateIssued：03-27-2020EffectiveDale：03-27-2020Status:Effective2008-2020AnnotationVersionNursesRegulation(PromulgatedbytheOrderNo.517oftheStateCouncilofthePeople'sRepublicofChinaonJanuary31,2008;andrevisedinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonMarch27,2020)ChapterIGeneralProvisionsArticle 1 ThisRegulationisformulatedwithaviewioprotectingthelegitimaterightsandinterestsofnurses,regulatingthenursingacts,promotingthedevelopmentofnursingcauseandguaranteeingthemedicalsafetyandphysicalhealthofpeople.Article 2 Theterm“nurses“asmentionedinthisRegulationreferstothehealthtechnicianswhohaveobtainedanurse护士条例（2008年1月31日中华人民共和国国务院令第517号公布根据2020年3月27日国务院关于修改和废止部分行政法规的决定修订）第一章总则第一条为了维护护士的合法权益，规范护理行为，促进护理事业发展，保障医疗安全和人体健康，制定本条例。第二条本条例所称护士，是指经执业注册取得护士执业证书，依照本条例规定从事护理活动，履行保护生practicecertificateuponpracticeregistration,areengagedin命、减轻痛苦、增进健康职责的卫生技术人员.第三条护士人格尊严、人身安全不受侵犯。护士依法履行职责，受法律保护。全社会应当尊重护士。第四条国务院有关部门、县级以上地方人民政府及 其有关部门以及乡（镇）人民政府应当采取措施，改善护 士的工作条件，保障护士待遇，加强护士队伍建设，促进 护理事业健康发展。国务院有关部门和县级以上地方人民政府应当采取措施, 鼓励护士到农村、基层医疗卫生机构工作。第五条国务院卫生主管部门负责全国的护士监督管 理工作。县级以上地方人民政府卫生主管部门负责本行政区域的护士监督管理工作。nursingactivitiesandperformthedutiesofprotectinglives,mitigatingpainsandenhancinghealthunderthisRegulation.Article 3 Thepersonaldignityandsafetyofnursesshallnotbeinfringedupon.Anurseisprotectedbylawduringperforminghis(her)dutiesinpursuanceoflaw.Thewholesocietyshallrespectnurses.Article 4 TherelevantdepartmentsoftheSlateCouncil,thelocalpeople'sgovernmentsatandabovethecountylevelandthepeople'sgovernmentsoftownships(towns)shalltakemeasurestoimprovetheworkingconditionsofnurses,guaranteethetreatmentstonurses,strengthentheconstructionoftheteamofnursesandpromotethesounddevelopmentofthenursingcause.TherelevantdepartmentoftheStateCouncilandthelocalpeople'sgovernmentsatandabovethecountylevelshallencouragenursestoworkinruralandgrassrootsmedicalandhealthinstitutions.Article 5 ThehealthdepartmentoftheStateCouncilshallberesponsibleforthesupervisionandadministrationofnursesthroughoutthecountry.Thehealthdepartmentsofthepeoplesgovernmentsatandabovethecountylevelshallberesponsibleforthesupervisionandadministrationofnurseswithintheirrespectiveadministrativearea.Article 6 TherelevantdepartmentoftheStateCouncilshallconferanadvancedworkerofthenationalhealthdepartmentsoraBethunemedalonanynursewhohasmadeoutstandingcontributionstothenursingwork.Acommendedorawardednurseisentitledtoenjoytreatmentstomodelworkersoradvancedworkersattheprovincialorministeriallevel.Anursewhoisengagedinthenursingworkforalongtermshallbegrantedanhonorarycertificate.ThemeasuresindetailshallbeformulatedbytherelevantdepartmentoftheStateCouncil.Thelocalpeople'sgovernmentsatandabovethecountylevelandtherelevantdepartmentsthereofshallcommendandawardthenurseswhohavemadeoutstandingcontributionswithintheirrespectiveadministrativeareaunderpertinentprovisionsofthepeople'sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment.ChapterIIPracticeRegistrationArticle 7 Apracticingnurseshallgothroughthepracticeregistrationandobtainapracticingnursecertificate.Anapplicantshallsatisfythefollowingconditionswhenapplyingforregistrationasapracticingnurse:(1) Havingcompletecivilcapacity;(2) Havingobtainedacorrespondingacademicdiplomaaftercompleting,inasecondaryvocationalschoolorhigher第六条国务院有关部门对在护理工作中做出杰出贡献的护士，应当授予全国卫生系统先进工作者荣誉称号或者颁发白求恩奖章，受到表彰、奖励的护士享受省部级劳动模范、先进工作者待遇；对长期从事护理工作的护士应当颁发荣誉证书。具体办法由国务院有关部门制定。县级以上地方人民政府及其有关部门对本行政区域内做出突出贡献的护士，按照省、自治区、直辖市人民政府的有关规定给予表彰、奖励。第二章执业注册第七条护士执业，应当经执业注册取得护士执业证书。申请护士执业注册，应当具备下列条件：（一）具有完全民事行为能力；（二）在中等职业学校、高等学校完成国务院教育主管部门和国务院卫生主管部门规定的普通全日制3年以上的护educationinstitute,3-yeargeneralfull-timestudyofcoursesinspecialtyofnursingordelivery,including8-monthorlongerclinicalnursinginternshipinateachingorcomprehensivehospital,asrequiredbytheeducationadministrativedepartmentoftheStateCouncilandthehealthdepartmentoftheStateCouncil;(3) HavingpassedthepracticingnursequalificationexamorganizedbythehealthdepartmentoftheStateCouncil;and(4) SatisfyingthehealthcriterionsasprescribedbythehealthdepartmentoftheStateCouncil.Anapplicantshallfileanapplicationforregistrationasapracticingnursewithin3yearsafterhe(she)passedthepracticingnursequalificationexam.Ifhe(she)failstofileanapplicationwithinthetimelimit,he(she)shall,besidestheconditionsasdescribedinItems，(2)and(4)oftheprecedingparagraph,accept3-monthclinicalnursingtraininginamedical&heathinstitution,whichsatisfiestheconditionsasprescribedbythehealthdepartmentoftheStateCouncil,andpasstheevaluation.ThemeasuresforthepracticingnursequalificationexamshallbeformulatedbythehealthdepartmentoftheStateCounciljointlywiththepersonneldepartmentoftheStateCoun
