DecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulations(2022)DocumentNumber：OrderNo.752oftheStateCouncilofthePeople'sRepublicofChinaAreaofLaw:Sort-OutofRegulationsandRulesOptimizationofDoingBusiness1.evelofAuthority：AdministrativeRegulationsIssuingAuthority：StateCouncilDateIssued：03-29-2022EffectiveDate：05-01-2022Status:EffectiveTopic：CivilCodeOrderoftheStateCouncilofthePeople'sRepublicofChina(No.752)TheDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsisherebyissued,andshallcomeintoforceonMay1,2022.Premier:LiKeqiangMarch29,2022DecisionoftheSlateCounciltoAmendandRepealCertainAdministrativeRegulationsForthepurposesofdeepeningthereformof“separatingpennitsfrombusinesslicenses,furtheradvancingthereformof“simplifyingprocedures,decentralizingpowers,combiningdecentralizationwithappropriatecontrol,andoptimizing中华人民共和国国务院令（第752号）现公布国务院关于修改和废止部分行政法规的决定，自2022年5月1日起施行。总理李克强2022年3月29日国务院关于修改和废止部分行政法规的决定为深化“证照分离”改革，进一步推进“放管服”改革，激发市场主体发展活力，维护国家法制统一、尊严和权威，国务院对“证照分离”改革涉及的行政法规，以及与民法典规定和原则不一致的行政法规进行了清理。同时，services/'energizingmarketparticipants,andsafeguardingtheunity,dignity,andauthorityofthenationallegalsystem,theStateCouncilhasreviewedtheadministrativeregulationsinvolvedinthereformof"'separatingpermitsfrombusinesslicenses''andthoseinconsistentwiththeprovisionsandprinciplesoftheCivilCode.Meanwhile,smoothconnectionisrequiredfollowingtheissuanceoftheRegulationontheWorkofPublicComplaintsandProposals.TheStateCouncilherebydecidesto:I. amendcertainarticlesof14administrativeregulations(seeAnnex1);andII. repealsixadministrativeregulations(seeAnnex2).ThisDecisionshallcomeintoforceonMay1,2022.Annexes:1.AdministrativeRegulationsAmendedasDecidedbytheStateCouncil2.AdministrativeRegulationsRepealedasDecidedbytheSlateCouncilAnnex1AdministrativeRegulationsAmendedasDecidedbytheStateCouncil1 .Article2oftheProvisionsontheAdministrationofForeign-FundedTelecommunicationsEnterprisesisamendedtoread:做好与信访工作条例出台的衔接。为此，国务院决定：一、对14部行政法规的部分条款予以修改。（附件二、对6部行政法规予以废止。（附件2）本决定自2022年5月1日起施行。附件：L国务院决定修改的行政法规2 .国务院决定废止的行政法规附件1国务院决定修改的行政法规一、将外商投资电信企业管理规定第.条修改为44Aforeign-fundedtelecommunicationsenterprisemeansanenterpriselegallyformedbyoneormoreforeigninvestorsintheterritoryofthePeople'sRepublicofChinaandengagedintheprovisionoftelecommunicationsservices.”Article6isamendedtoread:"Theultimateproportionofcapitalcontributionbytheforeigninvestorsinaforeign-fundedtelecommunicationsenterpriseengagedinIheprovisionofbasictelecommunicationsservices(excludingtheradiopagingservices)shallnotexceed49%,exceptasotherwisespecifiedbythestate.“Theultimateproportionofcapitalcontributionbytheforeigninvestorsinaforeign-fundedtelecommunicationsenterpriseengagedintheprovisionofvalue-addedtelecommunicationssen,ices(includingtheradiopagingservicesinthebasictelecommunicationsse,ices)shallnotexceed50%,exceptasotherwisespecifiedbythestate.”Subparagraph(4)inparagraph1ofArticle9andArticles10,12,14,15,16,and19aredeleted.Article11isrenumberedasArticle10andamendedtoread:“Aforeign-fundedtelecommunicationsenterpriseshall,afterundergoingthemarketparticipantregistrationinaccordancewiththelaw,applyforatelecommunicationsbusinesspermittothedepartmentofindustryandinformationtechnologyoftheStateCouncilandsubmitthefollowingdocuments:“外商投资电信企业，是指外国投资者依法在中华人民共和国境内设立的经营电信业务的企业。”将第六条修改为“经营基础电信业务（无线寻呼业务除外）的外商投资电信企业的外方投资者在企业中的出资比例，最终不得超过49%,国家另有规定的除外。“经营增值电信业务（包括基础电信业务中的无线寻呼业务）的外商投资电信企业的外方投资者在企业中的出资比例，最终不得超过50笔,国家另有规定的除外。”删去第九条第一款第（四）项、第十条、第十二条、第十四条、第十五条、第十六条、第十九条。将第十一条改为第十条，修改为“外商投资电信企业，经依法办理市场主体登记后，向国务院工业和信息化主管部门申请电信业务经营许可并报送下列文件：t(l)Explanatorydocumentsoninvestors.“（一）投资者情况说明书;“（二）本规定第八条、第九条规定的投资者的资格证明或者有关确认文件；t(2)CredentialsofinvestorsorotherrelevantconfirmationdocumentsassetforthinArticles8and9oftheseProvisions.“（三）电信条例规定的经营基础电信业务或者增值电信 业务应当具备的其他条件的证明或者确认文件。tt(3)Certificatesorconfirmationdocumentsonanyotherconditionsthatshallbesatisfiedforbeingengagedintheprovisionofbasictelecommunicationsservicesorvalue-addedtelecommunicationsservicesassetforthintheTelecommunicationsRegulation.“国务院工业和信息化主管部门应当自收到申请之日起对 前款规定的有关文件进行审查。属于基础电信业务的，应 当在受理申请之日起180日内审查完毕，作出批准或者不 予批准的决定；属于增值电信业务的，应当在收到申请之 日起60日内审查完毕，作出批准或者不予批准的决定。予 以批准的，颁发电信业务经营许可证；不予批准的， 应当书面通知申请人并说明理由。”“ThedepartmentofindustryandinformationtechnologyoftheStaleCouncilshallexaminetherelevantdocumentsasmentionedintheprecedingparagraphfromthedateofreceiptoftheapplication.Forbasictelecommunicationssen,ices,itshall,within180daysofacceptanceoftheapplication,completetheexaminationandmakeadecisiontoapproveordisapprovetheapplication;orforvalue-addedtelecommunicationsservices,itshall,within60daysofreceiptof(heapplication,completetheexaminationandmakeadecisiontoapproveordisapprovetheapplication.Itshall,inthecaseofapproval,issueaTelecommunicationsBusinessPermittotheapplicant,orinthecaseofdisapproval,notifytheapplicantinwriting,withanexplanationofthereasonsforthedisapproval.,将第十三条改为第十一条，修改为“外
