中华人民共和国渔业法实施细则（1987年10月14日国务院批准1987年10月20日农牧 渔业部发布）第一章总则第一条根据中华人民共和国渔业法（以下简 称渔业法）第三十四条的规定，制定本实施细则。第二条渔业法及本实施细则中下列用语的含 义是：DetailedRulesfortheImplementationoftheFisheriesLawofthePeople,sRepublicofChinaAreaofLaw:FisheryAdministration1.evelofAuthority：AdministrativeRegulationsIssuingAuthority：MinistryofAgriculture,AnimalHusbandry&FiShery(replaced)DateApproved：10-14-1987DateIssued：10-20-1987EffectiveDale:10-20-1987ApprovingAuthority:StateCouncilStatus：RevisedRevisedby:DecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulations(2020)(Issuedon03-27-2020Effectiveon03-27-2020)PkulawNoteDecisionoftheStateCouncilonCancellationandAdjustmentoftheSixthBatchofAdministrativeApprovalItems(Issuedon09-23-2012Effectiveon09-23-2012)1987-2020AnnotationVersionDetailedRulesfortheImplementationoftheFisheriesLawofthePeople'sRepublicofChina(ApprovedbytheStateCouncilonOctober14,1987,andissuedbytheMinistryofAgriculture,HusbandryandFisheryonOctober20,1987)ChapterIGeneralProvisionsArticle 1 TheseDetailedRulesareformulatedinaccordancewithArticle34oftheFisheriesLawofthePeople'sRepublicofChina(hereinafterreferredtoasthe“FisheriesLaw").Article 2 ForthepurposesoftheFisheriesLawandtheseDetailedRules,thefollowingtermsshallbedefinedasfollows:1. “internalwatersofthePeople'sRepublicofChina”meanstheseaslocatedonthelandwardsideofthebaselinefromtheterritorialseaofthePeople'sRepublicofChina,aswellasrivers,lakesandotherinlandwaters.2. “allotherseasunderthejurisdictionofthePeople'sRepublicofChinameanstheseasunderIhejurisdictionofthePeople'sRepublicofChinainaccordancewiththelawsofthePeople'sRepublicofChinaandtheinternationaltreaties,agreementsorotherrelevantinternationallawsconcludedoraccededtobythePeople'sRepublicofChina.3. “fisherywaters“meansthespawningfans,feedingfarms,winteringfarms,andmigratorypassagesoffish,shrimps,crabs,andshellfishaswellastheaquaticfarmsforfish,shrimps,crabs,shellfish,algaeandotheraquaticplantsandanimalsonthewatersunderIhejurisdictionofthePeople'sRepublicofChina.ChapterIIFisherySupervisionandAdministrationArticle3FiSherysupervisionandadministrationshallbesubjecttounifiedleadershipandgradedadministrationbythestate.Fishingactivitiesonwatersoutside*thelineofclosedfishingareasforbottomtrawlfishingbymotorizedfishingvessels”asdelineatedbytheStateCouncilthatareunderthejurisdiction（一）“中华人民共和国的内水”，是指中华人民共和国领海基线向陆一侧的海域和江河、湖泊等内陆水域。（二）“中华人民共和国管辖的一切其他海域”，是指根据中华人民共和国法律，中华人民共和国缔结、参加的国际条约、协定或者其他有关国际法，而由中华人民共和国管辖的海域。（三）“渔业水域”，是指中华人民共和国管辖水域中鱼、虾、蟹、贝类的产卵场、索饵场、越冬场、涧游通道和鱼、虾、蟹、贝、藻类及其他水生动植物的养殖场所。第二章渔业的监督管理第三条国家对渔业的监督管理，实行统一领导、分级管理。国务院划定的“机动渔船底拖网禁渔区线”外侧，属于中华人民共和国管辖海域的渔业，由国务院渔业行政主管部门及其所属的海区渔政管理机构监督管理；“机动渔船底拖网禁渔区线”内侧海域的渔业，除国家另有规定者外， 由毗邻海域的省、自治区、直辖市人民政府渔业行政主管 部门监督管理。内陆水域渔业，按照行政区划由当地县级以上地方人民政 府渔业行政主管部门监督管理；跨行政区域的内陆水域渔 业，由有关县级以上地方人民政府协商制定管理办法，或 者由上一级人民政府渔业行政主管部门及其所属的渔政监 督管理机构监督管理：跨省、自治区、直辖市的大型江河 的渔业，可以由国务院渔业行政主管部门监督管理。重要的、涧游性的共用渔业资源，由国家统管理；定居 性的、小宗的渔业资源，由地方人民政府渔业行政主管部 门管理。ofthePeople'sRepublicofChinashallbesupervisedandadministeredbythefisherj,administrativedepartmentoftheStateCouncil;andfishingactivitiesonwatersinside“thelineofclosedfishingareasforbottomtrawlfishingbymotorizedfishingvessels“asdelineatedbytheStateCouncilshallbesupervisedandadministeredbythefisheryadministrativedepartmentsofthepeople'sgovernmentsoftheprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentadjacenttotheseas,unlessitisotherwiseprovidedforbythestate.Fishingactivitiesoninlandwatersshallbesupervisedandadministeredbythefisheryadministrativedepartmentsoflocalpeople'sgovernmentsatorabovethecountylevelaccordingtoadministrativedivisions.Withrespecttofishingoninlandwatersacrossadministrativeregions,Iherelevantlocalpeople'sgovernmentsatorabovethecountylevelthroughconsultationsshallformulatetheadministrativemeasuresthroughconsultation,orthefisheryadministrativedepartmentofthepeople'sgovernmentatthenexthigherlevelandtheirsubordinatesupervisoryinstitutionsoffisheryadministrationshalltakechargeofthesupervisionandadministrationthereof.Fishinginlargeriversacrossdifferentprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentmaybesupervisedandadministratedbythefisheryadministrativedepartmentoftheStateCouncil.Importantandmigratorysharedfisheryresourcesshallbeadministeredbythestateinaunifiedmannerandsettledandsmallfisheryresourcesshallbeadministeredbythefisheryadministrativedepartmentsofthelocalpeople'sgovernments.第四条''机动渔船底拖网禁渔区线”内侧海域的 渔业，由有关省、自治区、直辖市人民政府渔业行政主管 部门协商划定监督管理范围；划定监督管理范围有困难 的，可划叠区或者共管区管理，必要时由国务院渔业行政 主管部门决定。Article4Thescopeofsupervisionandadministrationoffisheryonwatersinside“thelineofclosedfishingareasforbottomtrawlfishingbymotorizedfishingvessels*,shallbedelineatedbythefisheryadministrativedepartmentsofrelevantprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment;ifitisdifficulttodelimitthescopeofsupervisionandadministration,relatedareasmaybedividedintooverlappingareasorco-adninister
