Generalrequirements以习近平新时代中国特色社会主义思想为指导，全面贯彻 落实党的十九大和十九届二中、三中、四中、五中全会精 神，坚持稳中求进工作总基调，坚持遵循法治轨道，着力 构建诚信建设长效机制，按照依法依规、保护权益、审慎 适度、清单管理的总体思路，进一步规范和健全失信行为 认定、记录、归集、共享、公开、惩戒和信用修复等机 制，推动社会信用体系迈入高质量发展的新阶段，更好发 挥社会信用体系在支撑“放管服”改革和政府职能转变、 营造公平诚信的市场环境和社会环境等方面的积极作用。UndertheguidanceofXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra,effortsshallbemadetocomprehensivelyimplementthespiritofthe19thCPCNationalCongressandthe2nd,3rd,4thand5thPlenarySessionsofthe19thCPCCentralCommittee,remaincommittedtothegeneralprincipleofpursuingprogresswhileensuringstability,persistentlyobsen,etheruleoflaw,andfocusonbuildingalong-termmechanismforpromotinggdfaith.Mechanismsforthedetermination,recording,collection,sharing,disclosure,punishmentandcreditrepairingofbad-faithactsshallbefurtherregulatedandimprovedundertheprinciplesoft4obscrvinglawsandregulations,protectingrightsandinterests,takingaprudentandappropriateapproachandimplementinglist-basedmanagement”.Thesocialcreditsystemshallbeupgradedtothenewstageofhigh-qualitydevelopment;andtheroleofthesocialcreditsysteminsupportingthereformof''simplificationofadministrativeprocedures,delegationofpowers,combinationofdecentralizationandappropriatecontrolandoptimizationofservices“andthetransformationofgovernmentfunctionsandincreatingafair,honestmarketenvironmentandsocialenvironmentshallbebetterleveraged.在社会信用体系建设工作推进和实践探索中，要把握好以Intheprogressandpracticeofbuildingthesocialcreditsystem,thefollowingessentialprinciplesmustbeadheredto:First,complyingwithapplicablelawsandregulations:Measuresinvolvingtherealinterestsofindividualsandbusinesses,suchasrecordingofbad-faithacts,determinationofthelistofseriouslydishonestindividualsandentities,andpunishmentforactsofbadfaith,amongothers,shallbeadoptedinstrictaccordancewiththelaw.Second,accuratelydefiningthescope:Thescopeofcreditinformationandthelistofseriouslydishonestindividualsandentitiesshallbeaccuratelydefined;measuresforpenalizingdishonestyshallbeproperlyimplemented;andinappropriateuseormisuseofsuchmeasuresshallbeavoided.Third,ensuringthatpunishmentiscommensuratewithactsofbadfaith:Punishmentmeasuresshallvaryintypeandseverityaccordingtothefieldsinwhichbad-faithactsoccur,aswellasthegravityandimpactofsuchacts;andthelawfulrightsandinterestsofthepartiesinvolvedshallbeeffectivelyprotected.Fourth,learningfrominternationalexperience:ThesocialcreditsystemshallbeprudentlyintroducedtofieldswherethereismuchpublicconcernaboutsocialintegrityandconsensushasyettobereachedbytakingintoconsiderationbothChina'slocalconditionsandinternationalpractices;andpropermeasuresshallbetakentoalignthesocialcreditsystemwithinternationalstandards.II. Definingthescopeandproceduresforincludingcertainactsinpubliccreditinformation1.Clearlydefiningthescopeofpubliccreditinformation:Theinformationofspecialactsinthepossessionofadministrativeorgansandorganizationswiththefunctionofadministeringpublicaffairsasauthorizedbylawsandregulations下重要原则：一是严格依法依规，失信行为记录、严重失信主体名单认定和失信惩戒等事关个人、企业等各类主体切身利益，必须严格在法治轨道内运行。二是准确界定范围，准确界定信用信息和严重失信主体名单认定范围，合理把握失信惩戒措施，坚决防止不当使用甚至滥用。三是确保过惩相当，按照失信行为发生的领域、情节轻重、影响程度等，严格依法分别实施不同类型、不同力度的惩戒措施，切实保护信用主体合法权益。四是借鉴国际经验，既立足我国国情，又充分参考国际惯例，在社会关注度高、认识尚不统一的领域慎重推进信用体系建设，推动相关措施与国际接轨。二、科学界定公共信用信息纳入范围和程序（一）明确界定公共信用信息范围。将行政机关及法律、法规授权的具有管理公共事务职能的组织等（以下统称行政机关）掌握的特定行为信息纳入公共信用信息，必须严(hereinafterreferredtoasadministrativeorgans' Strictly regulating the basis on which bad-faith acts aredetermined: Administrative organs must
