民用航空危险品运输管理规定(2024)ProvisionsontheAdministrationoftheTransportofDangerousCargobyCivilAviation(2024)制定机关：交通运输部发文字号：中华人民共和国交通运输部令2024年第4号公布日期：2024.01.18施行日期：2024.07.01效力位阶：部门规章法规类别：航空运输特种行业和危险品管理IssuingAuthority：MinistryofTransportDocumentNumber：OrderNo.42024oftheMinistryofTransportofthePeople'sRepublicofChinaDateIssued：01-18-2024EffectiveDate：07-01-20241.evelofAuthority：DepartmentalRulesAreaofLaw：AirTransportAdministrationofSpecialIndustriesandDangerousArticles中华人民共和国交通运输部令OrderoftheMinistryofTransportofthePeople'sRepublicofChina(No. 4 2024)（2024年第4号）民用航空危险品运输管理规 定已于2024年1月12日经 第1次部务会议通过，现予公 布，自2024年7月1日起施 行。部长李小鹏2024年1月18日TheProvisionsontheAdministrationoftheTransportofDangerousCargobyCivilAviation,asadoptedatthe1stexecutivemeetingoftheMinistryofTransportonJanuary12,2024,areherebyissued,andshallcomeintoforceonJuly1,2024.Minister:LiXiaopengJanuary18,2024ProvisionsontheAdministrationoftheTransportofDangerousCargobyCivilAviationChapter I GeneralPrinciplesArticle1Forthepurposesofstrengtheningtheadministrationofthetransportofdangerouscargobycivilaviation,regulatingthetransportofdangerouscargobyair,andguaranteeingthesafetyoftransportbycivilaviation,theseProvisionsaredevelopedaccordingtotheCivilAviationLawofthePeople'sRepublicofChina,theWorkSafetyLawofthePeople'sRepublicofChina,theCounterterrorismLawofthePeople'sRepublicofChina,theRegulationontheSafetyManagementofHazardousChemicalsandotherlawsandadministrativeregulations.Article2TheseProvisionsshallapplytocarriers,airportmanagementinstitutions,groundserviceagents,dangerouscargotraininginstitutions,institutionscarryingoutcivilaviationsafetyinspectionandotherentitiesandindividualscarryingoutactivitiesrelatedtothetransportofdangerouscargobycivilaviationintheterritoryofthePeople'sRepublicofChina.TheseProvisionsshallapplytoforeigncarriersorcarriersfromHongKong,MacaoandTaiwanthatcarryoutactivitiesspecifiedintheprecedingparagraphandwhoseoneoftheplacesofdeparture,stopoverordestinationofflightisintheterritoryofthePeople,sRepublicofChina(excludingHongKong,MacaoandTaiwan).民用航空危险品运输管理规定第一章总则第一条为了加强民用航 空危险品运输管理，规范危险 品航空运输活动，保障民用航 空运输安全，根据中华人民 共和国民用航空法中华人 民共和国安全生产法中华 人民共和国反恐怖主义法 危险化学品安全管理条例 等法律、行政法规，制定本规 定。第二条中华人民共和国 境内的承运人、机场管理机 构、地面服务代理人、危险品 培训机构、从事民航安全检查 工作的机构以及其他单位和个 人从事民用航空危险品运输有 关活动的，适用本规定。外国承运人、港澳台地区承运 人从事前款规定的活动，其航 班始发地点、经停地点或者目 的地点之一在中华人民共和国 境内（不含港澳台，下同） 的，适用本规定。第三条中国民用航空局 （以下简称民航局）负责对民 用航空危险品运输活动实施统 一监督管理。Article3TheCivilAviationAdministrationofChina(uCAACn)shallberesponsiblefortheunifiedsupervisionandadministrationofthetransportofdangerouscargobycivilaviation.TheCAACregionaladministrationsshallberesponsibleforimplementingsupervisionandadministrationofthetransportofdangerouscargobycivilaviationwithintheirrespectivejurisdictions.TheCAACandCAACregionaladministrationsarecollectivelyreferredtoasCAACadministrations.Article4EntitiesandindividualscarryingoutactivitiesrelatedtothetransportofdangerouscargobycivilaviationshallsatisfytherequirementsofAnnex18SafeTransportofDangerousCargobyAirandTechnicalInstructionstotheConventiononInternationalCivilAviation,unlessotherwiseprescribedbylaws,regulationsandrules.Article5Therelevantindustryassociationshallstrengthenindustrialself-regulation,promoteintegrityconstruction,urgememberstocarryoutpublictransportofdangerouscargobyairinaccordancewiththelaw,andimprovetheservicequality.Chapter II TransportRestrictionsArticle6Anyentityorindividualshallnotcarryinbaggageorconsign,receiveortransportbycargoormaildangerouscargowhichareprohibitedtobetransportedbyairunderanycircumstanceasstipulatedintheTechnicalInstructions.中国民用航空地区管理局（以 下简称民航地区管理局）负责 对本辖区内的民用航空危险品 运输活动实施监督管理。民航局和民航地区管理局统称 为民航行政机关。第四条从事民用航空危 险品运输有关活动的单位和个 人应当遵守国际民用航空公 约附件18危险物品的安全 航空运输及技术细则的 要求；法律、法规、规章另有 规定的，还应当遵守其规定。第五条有关行业协会应 当加强行业自律，推进诚信建 设，促进会员依法开展公共航 空危险品运输活动，提升服务 质量。第二章运输限制第六条任何单位和个人 不得在行李中携带或者通过货 物、邮件托运、收运、载运 技术细则中规定的在任何 情况下禁止航空运输的危险 品。第七条除运输安全水平Article7UnlessthesafetyleveloftransportsatisfiestherequirementsandisapprovedorexemptedbytheCAACadministrationinaccordancewiththeTechnicalInstructions,noentityorindividualshallcarryinbaggageorconsign,receiveortransportthefollowingdangerouscargobycargoormail:符合要求并获得民航行政机关按技术细则给予批准或者豁免外，任何单位和个人不得在行李中携带或者通过货物、邮件托运、收运、载运下列危险品:(1) AnydangerouscargoprohibitedtobetransportedbyairundernormalcircumstancesasstipulatedintheTechnicalInstructions.(2) Anyinfectedlivinganimal.Article8Theconsignment,receiptandtransportofamailcontainingdangerouscargoshallsatisfytherequirementsofrelevantpostallawsandregulations,theseProvisionsandtheTechnicalInstructions.Article9ArticlesorsubstancesfallingunderthefollowingcircumstancesarenotsubjecttorestrictionsonthetransportofdangerouscargobyairinaccordancewiththeprovisionsoftheTechnicalInstructions:(1) Anyarticleorsubstancethathasbeenclassifiedasdangerouscargobutneedstobeuploadedontoacivilaircraftpursuanttotheairworthinessrequirementsandoperationrulesorduetoanyotherspecialreasonliste
