中华人民共和国国务院组织法(2024修订)OrganicLawoftheStateCouncilofthePeoplefSRepublicofChina(2024Revision)制定机关：全国人民代表大会发文字号：中华人民共和国主席令第21号公布日期：2024.03.11施行日期：2024.03.11效力位阶：法律法规类别：组织法IssuingAuthority：NationalPeople'sCongressDocumentNumber：OrderNo.21ofthePresidentofthePeople'sRepublicofChinaDateIssued：03-11-2024EffectiveDale：03-11-20241.evelofAuthority：LawsAreaofLaw:OrganizationLawOrderofthePresidentofthePeople'sRepublicofChina中华人民共和国主席令(No.21)（第二十一号）TheOrganicLawoftheStateCouncilofthePeople'sRepublicofChina,asrevisedandadoptedatthe2ndSessionoftheFourteenthNational中华人民共和国国务院组织法已由中华人民共和国第十四届全国人民代表大会People'sCongressofthePeople,sRepublicofChinaonMarch11,2024,isherebyissued,andshallcomeintoforceonthedateofissuance.第二次会议于2024年3月11日修订通过，现予公布，自公布之日起施行。XiJinping5PresidentofthePeople'sRepublicofChina中华人民共和国主席平习近March11,20242024年3月11日中华人民共和国国务院组织 法（1982年12月10日第五届 全国人民代表大会第五次会 议通过并于同日公布施行 2024年3月11日第十四届 全国人民代表大会第二次会 议修订）第一条为了健全国务 院的组织和工作制度，保障 和规范国务院行使职权，根 据宪法，制定本法。第二条中华人民共和 国国务院，即中央人民政 府，是最高国家权力机关的 执行机关，是最高国家行政 机关。第三条国务院坚持中 国共产党的领导，坚持以马 克思列宁主义、毛泽东思 想、邓小平理论、“三个代 表”重要思想、科学发展 观、习近平新时代中国特色 社会主义思想为指导，坚决 维护党中央权威和集中统一 领导，坚决贯彻落实党中央 决策部署，贯彻新发展理 念，坚持依法行政，依照宪 法和法律规定，全面正确履 行政府职能。OrganicLawoftheStateCouncilofthePeople'sRepublicofChina(Adoptedatthe5thSessionoftheFifthNationalPeople'sCongressonDecember10,1982andissuedandtookeffectonthesameday,andrevisedatthe2ndSessionoftheFourteenthNationalPeople'sCongressonMarch11,2024)Article1ThisLawisenactedinaccordancewiththeConstitutionforthepurposesofimprovingtheorganizationandworkingsystemoftheStateCouncil,andsafeguardingandregulatingtheStateCouncil'sexerciseoffunctionsandpowers.Article2TheStateCouncilofthePeople'sRepublicofChina,thatis,theCentralPeople'sGovernment,istheexecutiveorganofthehighestorganofstatepowerandthehigheststateadministrativeorgan.Article3TheStateCouncilshalladheretotheleadershipoftheCommunistPartyofChina,adheretotheguidanceofMarxism-Leninism,MaoZedongThought,DengXiaopingTheory,theimportantthoughtofThreeRepresents,theScientificOutlookonDevelopment,andXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra,resolutelyupholdtheauthorityandcentralizedandunifiedleadershipoftheCPCCentralCommittee,resolutelyimplementthedecisionsandarrangementsmadebytheCPCCentralCommittee,carryoutnewdevelopmentphilosophy,adheretolaw-basedadministration,andfullyandcorrectlyperformgovernmentfunctionsinaccordancewiththeConstitutionandlaws.TheStateCouncilshalladheretoapeoplecenteredapproachandservethepeoplewholeheartedly,adheretoanddevelopwholeprocesspeople'sdemocracy,alwaysmaintainclosecontactwiththepeople,listentotheopinionsandrecommendationsofthepeople,andbuildalawbased,innovative,clean,andservice-orientedgovernmenttothesatisfactionofthepeople.Article4TheStateCouncilshallberesponsibletoandreportworktotheNationalPeople,sCongressor,whentheNationalPeople'sCongressisnotinsession,toitsStandingCommittee.TheStateCouncilshallconscientiouslyacceptsupervisionbytheNationalPeople'sCongressanditsStandingCommittee.Article5TheStateCouncilshallbecomposedofthePremier,Vice-Premiers5StateCouncilors,ministersofallministries,directorsofallcommissions,GovernorofthePeople'sBankofChina,Auditor-General,andSecretary-General.ThePremiershallassumeoverallresponsibilityfortheworkoftheStateCouncil.ThePremiershallhaveleadershipovertheworkoftheStateCouncil.国务院坚持以人民为中心、 全心全意为人民服务，坚持 和发展全过程人民民主，始 终同人民保持密切联系，倾 听人民的意见和建议，建设 人民满意的法治政府、创新 政府、廉洁政府和服务型政 府。第四条国务院对全国 人民代表大会负责并报告工 作；在全国人民代表大会闭 会期间，对全国人民代表大 会常务委员会负责并报告工 作。国务院应当自觉接受全国人 民代表大会及其常务委员会 的监督。第五条国务院由总 理、副总理、国务委员、各 部部长、各委员会主任、中 国人民银行行长、审计长、 秘书长组成。国务院实行总理负责制。总 理领导国务院的工作。副总理、国务委员协助总理 工作，按照分工负责分管领 域工作；受总理委托，负责TheVice-PremiersandStateCouncilorsshallassistthePremierinhisorherwork,andberesponsiblefortheirrespectivework;beresponsiblefortheworkinotheraspectsorspecialtasksasdelegatedbythePremier;andaccordingtouniformarrangements,carryoutforeignaffairsactivitiesonbehalfoftheStateCouncil.Article6TheStateCouncilshallexercisethefunctionsandpowersprescribedintheConstitutionandrelevantlaws.Article7TheStateCouncilshallimplementthesystemofplenaryandexecutivemeetingsoftheStateCouncil.TheplenarymeetingsoftheStateCouncilshallbecomposedofallmembersoftheStateCouncil.TheexecutivemeetingsoftheStateCouncilshallbecomposedofthePremier,VicePremiers,StateCouncilors,andSecretary-General.ThePremiershallconveneandpresideovertheplenaryandexecutivemeetingsoftheStateCouncil.MajorissuesintheworkoftheStateCouncilmustbediscussedanddecidedatanexecutiveorplenarymeetingoftheStateCouncil.Article8ThemaintasksofplenarymeetingsoftheStateCouncilaretodiscussanddecideonmajorissuesintheworkoftheStateCouncil,suchasreportsontheworkofthegovernmentandnationaleconomicandsocialdevelopmentplans,andmakearrangementsontheimportantworkoftheStateCouncil.ThemaintasksofexecutivemeetingsoftheStateCouncilaretodiscussdraftlaws,deliberateondraftadministrativeregul
